I Spivey Fulller of said State and County being of advance age and knowing that I must shortly depart from this world ? it right and proper both as regards myself and my family that I should make a disposition of the property with which of kind Providence has ? now, I therefore make this my last Will and testament hereby making all things made by new. Item 1st, I decree and direct that all my just debts be paid without delay by my executor hereinafter named as I am (willing?) my condition should be delayed of their rights especially as theirs is ? see ? for delay. Item 2 I give and decree to my beloved wife Sarah with whom I have lived in the strictest quite and love for thirty years all the household and kitchen furniture that she wants one Sorrel mare Lucy, buggy and hemp as a special legacy, also provisions for one year for herself and ? Item 3, I decree and bequeath to my three youngest sons, Robert S., Mark A.G., and William H. H. Fuller one hundred dollars each as a special legacy. Item 4th, It is my wish that all the balance of my estate not named in item first should be sold and after paying all the specific legacies warred in items first ? to be equally divided among my heirs terit? my wife Sarah Catherine, A.M. Lazenby deceased, Mary Jane Lee wife of Hiram G. Lee, James S.Jr, Thomas J., Robert S, mark A. G., and William H.H. Fuller. Item 5th, It is my will that that portion of my estate which is bequeathed to my daughters namely Catherine A.M. Lazenby , wife of Robert Lazenby deceased, and Mary Jane Lee wife of Hiram G. Lee should be exempt from any debt or contract of the present or future husband and shall be (for?) the one of them and their heirs forever. Item 6th, It is my wish that my executor hereinafter named shall advertise for sale and sell out all my estate ? given to my wife Sarah as early as he conveniently can, with out and legal process of L Item 7 I constitute and appoint my friend Wilken Linch executor to this my last will and testament this June 21st 1861 Spivey Fuller Sign and sealed, did and published? by Spivey Fuller, his last will and testament in the presence of ? subscriber who subscribed ? praising in the presence of said titabes and of each other the day and year above written.
