Will of Giles Tompkins 03 May 1841 Putnam County, GA I Giles Tompkins of the county and state aforesaid in the name of God, amen, being of sound memory and disontion do make establish and publish this my last will and testament hereby revoking all others by me made. Item 1st It is my will and desire that all my just debts be paid. Item 2nd I give and bequeath unto my beloved wife Sarah Tompkins five hundred dollars to be at her own control and disposal absolutely and unqualifiedly. Item 3rd I also give and bequeath unto my beloved wife during her natural life or widowhood the whole of the plantation or lands whereon I now live together with all and singular the tenements and appustinances thereunto belonging and all the household and kitchen furniture horses, stock and cattle of every discription farming utensils and implements of said farm and all the crop which may be on hand at the time of my decease. I also give and bequeath unto her during her natural life or widowhood the following negro slaves, to wit, Chance, Milky, Gloster, Munca, Milton, Eamy, Martha, Isew and Rachel to be kept by my wife on the said farm unless some of them should become unruly and unmanageable and in that event such slaves to be hired out by my wife and Executors hereinafter named. Item 4th After the death of my beloved wife I give and bequeath unto Nicholas Tompkins and John Tompkins my sons the whole of the plantation or lands whereon I now live with all the appustenances, Horses, Hogs, stock cattle farming utensils and such crop as may be on hand at the time of the decease of my wife, all the property in these items named I give unto the said Nicholas and John and their heirs forever to be divided at the time aforesaid equally between them. Item 5th I give and bequeath unto my son John Tompkins his heirs and assigns at the death of my beloved wife, Milton a negro man slave. Item 6th I give and bequeath unto my son Nicholas Tompkins his heirs and assigns forever after the death of my beloved wife, a negro man slave Mesica. Item 7th I give and bequeath unto my granddaughter Mary Scott and her heirs forever at the death of my wife, Rachel a girl and her increases the said negro and her increase to be for the separate use maintenance of my said grand daughter Mary and her heirs, and I hereby appoint Irby H Scott a trustee for my said grand daughter and her heirs for the purposes in this item named. Item 8th I give and bequeath unto my granddaughter Sarah Thomasson her heirs and assigns forever after the death of my wife, a negro boy Sam, the said negro boy to be for the separate use and maintenance of my said granddaughter Sarah and her heirs forever and I hereby appoint B. F. Thomasson a trustee for my granddaughter Sarah and her heirs for the purposes in this item named. Item 9th I give and bequeath unto my grandson Ean (?) Morrison after the death of my wife two choice feather beds bedsteads and such furniture as his grandmother my assign for such beds, I also give and bequeath unto my said grandson, at the death of my wife for the time of his natural life, Gloster, a negro man slave, who is to take care of attend and wait upon my said grandson during this my said grandsons life and at his death the said Gloster is to live and remain with such one of my said children or grandchildren as he may select and not be exposed to public sale and such child or grand child is to act as a guardian over said Gloster. Item 10th It is my will and desire that my two old negro slaves Chance and Milky should never be exposed to public sale but that at the death of myself and my wife Chance shall go and remain with my son John Tompkins during the life of my said son and not be considered as a part of his estate as divided and at this my said sons death the said Chance to select a home among some of my children or grand children and that Milky, after the death of myself and wife shall go to and remain with my granddaughter Sarah Thomas on and after her death to select a home among some other of my grandchildren and that said Milky be not considered as a part of the said Sarah' estate ? Item 11th I appoint John Tompkins, Nicholas Tompkins and Irby H Scott, executors to this my last will and testament. In testimony I the said Giles Tompkins have hereunto set my hand and in presence of the undersigned witnesses and the undersigned witnesses after seeing the said Giles sign this will have subscribed the same as witnesses in his presence Thomas Glaze X (his mark) Giles Tompkins Wm.
