S. Queen respectfully showeth that Samuel Queen, late of said County, departed this life on the 6th day of December 1905, leaving your petitioner, his widow, and one minor child surviving him, and she prays your Honorable Court, with the statute in such case made and provided, to appoint five discreet and proper persons to ---appraisers in setting apart to your petitioner and the aforesaid minor child as aforesaid the sum necessary in their judgement, for support for the space fo twelve months form the death of said Samuel P. Queen of your petitioner and her child, either in money or such property as may be selected by your petitioner, at a fair valuation, to be made by said appraisers. And also to set apart a sufficient amount of household furniture for the use of your petitioner and her children. And further, to require said appraisers to return to you for record their proceedings. And you petitioner will ever pray etc. H. S. Queen Petitioner Rabun Court of Ordinary-At Chambers Upon the foregoing application of H. S. Queen the widow of Samuel P. Queen deceased, for the appointment of appraisers to set apart to said widow and her one minor child, a sum necessary for their support and maintenance for the space of twelve months, out of the estate of said Samuel P. Queen, deceased, and also to set apart for the use of said widow and child a sufficient amount of household furniture, it is ordered that Jno. R. Scruggs, Jas. R. Grant, D. M. Green, Jas. N. Fisher and V. A. Green be and they are hereby appointed appraisers, and they or a majority of them, are hereby empowered to set off and assign to the said H. S. Queen, widow of Samuel P. Queen deceased, late of said County, and her one minor child, out of the estate of the said deceased, a sum necessary for the support and maintenance of said widow and child for the space of twelve months; and also a sufficient amount of house hold furniture for the use of said widow and child. And the said sum so set apart as aforesaid to be either in Further ordered that said appraisers return to me for record all their proceedings in the premises. Queen of Rabun County, late of said County, deceased for the support and maintenance of said widow and minor child of said deceased, for the term of twelve months, out of the estate of said deceased; Now know ye by these presents, that you or any three of you, whose names are herein above written, are authorized and empowered to attend and set apart and assess the sum necessary for the support and maintenance of the family aforesaid, out of the estate of said S. P. Queen deceased, for the space of twelve months, either in money or such property as the said widow may select, do report that we have assessed and set apart as being necessary for the support and maintenance of said widow and child Arthur Queen One Hundred and five Dollars which said widow has selected to take as follows; All of the household and kitchen furniture, value 15.00 One black and white spotted sow with 8 pigs 5.00 One light strawberry roane cow about 7 years old known as the Samuel Taylor, Sr. cow 10.00 Also that tract or parcel of land situated lying and being in the 2nd land Dist. of Rabun County Georgia known and distinguished in the plan of said District as parts of lots Nos. 62 and 63, Bounded as follows; commencing near a White oak stump and running down the creek to the mouth of a small branch, thence up said branch to the original line, thence with said line to the South corner, thence with the old line west to the Right of way of the Rail Road, thence up the Road to the beginning corner, containing One Hundred acres more or less. Except that portion of said tract sold by S. P. Queen to Tyra Queen as recorded in Book "S" Records of Deeds of Rabun County Georgia, Page 369 value of said land; 75.00 Total $105.00 In witness whereof we have hereunto set our hands this day the 19th day of January 1906. P. Queen, and appraisers duly appointed to set apart the same, having filed their return, all persons concerned are hereby required to show cause before the Court of Ordinary of said County on the first Monday in March next, why should not be granted. S. Queen, widow of Samuel P. Queen deceased for Years support out of the estate of said deceased and for grounds of objection say; 1st. Because the property set apart is worth more than five hundred Dollars; to wit the sum of one thousand Dollars or other large sum, and the setting apart the whole estate of said deceased is doing injustice to those interested in the same as heirs and creditors, and these caveators are such. 2nd. Because James R. Grant Attorney at law pretended to act as one of the appraisers or commissioners to set apart the years support when he was then spoken to represent these interested in the whole estate being so set apart. W. S. Paris Caveators Attorney And now comes the within named caveators and withdraw and dismiss the within caveat or exceptions. This April 2nd 1906. W. S.
