Forrester, Justices It appearing to the Court that the Blue Ridge Rail Road is located and will be constructed upon lands in the second district of Rabun County belonging severally to Jesse Jones, Albert Dillard, James W. Carter, Jesse Carter, Thomas Carter, Hiram Gibson, John W. Scruggs, Amos McCurry, Elizabeth QUEEN (wife of Hugh QUEEN) and her children, Samuel QUEEN, Stephen Whitmire, Bailey Carpenter dec? and Samuel Beck; upon lands in the third district of said County belonging severally to Samuel Beck, the Estate of Wm. D. Langston, dec.?, William Kelly and Miles Wall, and upon lands in the fourth district of said County belonging to Miles Wall.-and it further appearing that such parts and portions of said lands as are necessary for said Rail Road, and the right of way through and upon said lands cannot be had for want of agreement between the said Rail Road Company and the said Jesse Jones, Albert Dillard, James W. Carter, Jesse Carter, Thomas Carter, Hiram Gibson, John W. Scruggs, Amos McCurry, Samuel QUEEN, Stephen Whitmire, Samuel Beck, William Kelly and Miles Wall, or either of them as to price; and because of the coverture? Of Elizabeth QUEEN and the minority of her children, there being no trustee to represent them, and because of the minority of all the children of William D. Langston dec? and because no person is known who has the power to agree and convey as to the said land of Bailey Carpenter dec? It is therefore ordered by the Court that McKenzie F. Cannon, John Keener and William T. Dickerson be and they are hereby appointed Commissioners under the charter to make valuation fo the right of way through and upon all of said lands, and to make valuation of such parts and portions of said lands and of such rights and priviliges upon the same as may be necessary for the use of said Rail Road. Page 135-137 To Samuel QUEEN for right of way over and upon lot of land number sixty three (63) in the second (2) district of said county and from all damages to said lot by borrowing and wasting earth thereon for the construction of said rail road upon said lot sixty dollars $60.00 said right of way to embrace the perpetual and exclusive use and occupation of a slip or belt of land along the line of said road as now located one hundred and sixty-two (162) feet wide at station 3250 and not exceeding one hundred (100) feet wide at any other point. The center line of said rail road and the right to use any earth wood stone or other material in and upon the said slip or belt of land and the further right to fell all trees that may stand so near said road as to endanger the same and the said borrowed earth to be taken from and the said wasted earth to be taken to the most convenient place or places at the discretion of the company's engineer outside of the space allowed for the right of way. To Elizabeth QUEEN and her children for right of way over and upon lot of land sixty-three (63) in the second (2) district of said county and for all the damage to said lot by borrowing and wasting earth thereon for the construction of said road upon said lot sixty five dollars $65.00 said right of way to embrace the perpetual and exclusive use and occupation of the slip or belt of land along the line of said rail road as now located fifty (50) feet wide at station 3261 and not exceeding fifty (50) feet wide at no other point from the center line thereof coexisting? Richy be and he is hereby appointed to act with John W. Scruggs, Chairman of the Rabun Turnpike Company and Hiram Gibson chosen by Mrs. Elizabeth QUEEN and Hugh QUEEN her husband in fixing the compensation to be paid the said Elizabeth QUEEN and her children for and on account of a change of route about to be made in the said Turnpike Road in and over lot of land number Sixty two in the second District of Rabun County the said Turnpike Company and the owners of said land being unable to agree upon the amount of such compensation. And it is further ordered that any moneys allowed as such compensation be paid over to the said Hugh QUEEN to be held by him for the use and benefit of the said Elizabeth QUEEN and her children. Page 175 Georgia Rabun County We the undersigned commissioners appointed under the charter of the Rabun Turn Pike Road to assess the damages that will be done to Lot of land number sixty two in the second district of said county for and on account of a change of road about to be made in the said Turnpike road over and upon said lot of land the property of Elizabeth QUEEN and her children, have performed the duties assigned us, and have assessed said damages at the sum of one hundred and fifteen dollars ($115.00).
