M Cannon Mason Grist Jesse Jones and Levy Hefner are held and firmly bound into the Honorable the Justices of the Inferior Court of said county sittin for ordinary purpose and their succession in office in the just and full sum of Two Thousand dollars for the true payment of which sum to the said Justices as aforesaid and their successions we bind our selves our heirs Executors and administrators in the whole and for the whole sum jointly and severally firmly by these presents sealed with our seals and dated this 19th day of December 1845. The Condition of the above obligation is such that if the above named Thomas Kelly, Red, Administrator of the estate real and personal of Samuel Hefner late of the County Deceased do made a true and perfect inventory of all the Estate real and personal fo said deceased which have or shall come to the hands possession or knowledge of the said Thomas Kelly Red or into the hand or possession of any other person or persons for him and this said so made do exhibit unto the said Court of Ordinary when he shall be there into required and such estate do well and truly administer according to law and do make a just and true account of his acting and doings there in when he shall page 191 be there into required by the Court of Ordinary for said county and all the rest of the said estate which shall be found remaining upon the account of the said Administration the same being first allowed by the court shall deliver and pay to such person or persons respectively as are entitled to the same by law and if it shall here after appear that any last will and testament was made by the said deceased and the same be proved before the Court and the executors obtain a Certificate of the probate there of and the said Thomas Kelly Red do in such case if required render and deliver up the said letter of Administration then this obligation to be void else to remain in full force Thomas Kelly Red Edward Coffee W. At this term comes Catharine Hefner widow of Saml Hefner decd in to court and claims her Dower in the lands belonging to said estate. page 236 It is ordered that Thomas Kelly adminstrator of Samuel Hefner deceased be allowed until the next term of this court to make his annal returns for the years 1846 and 1847. page 237 Ordered that Thomas Kelly adminstrator of the estate of Samuel Hefner deceased be and and he is bereby authorized and advised to submit to arbitration any difference or dispute which now exists or may arise between him & Ephraim Hefner in relation to a clay bank mare and colt supposed to belong to the estate of Samuel Hefner deceased. page 307 November adjourned term 1846 Nov 19 The court met per-erant to adjournment present their honor Edward Coffee, William McKinney & John Keenes. Ordered that Thomas Kelly admin of Samuel Hefner dcd have leave & leave is hereby granted him to sell all the real estate belonging to said decd - The said administrator having heretofor published his hour months notice for the application for this order according to law.
