THIS INDENTURE made the fifteenth day of August in the year of our Lord Christ One thousand & seven hundred & seventy-six, BETWEEN Daniel Richardson in the Province & Parish of Georgia and Parish of Siaint Paul of the one part and Jonathan Clyatt of the same Province & Parish of the other part.WIITNESSE'lH that for and in consideration or the sum of ten poundsl current money of Georgia in hand paid to him the said Janiel Richardson the receipt whereof is hereby acknowledged he the said Daniel Richardson hath granted bargained, sold, Aliened Enfeoffed conveyed and confirmed and by these presents doth bargain sell alien enfoeffe convey and confirm unto the said Jonathan Clyatt his Heirs and his assigns forever a certain tract piece or parcel of land containing seventy six acres situate, lying and being in.the Province & Parish aforesaid, and on a branch of.Red Creek: and joining Isaac Cliatts and other lands of the said Daniel Richardson, and is bounded as follows Vizt. beginning at a white oak thence So. 70 'w 31 chains to a red Oak, thence Do. 20 W 12 Chains to a stake in Richardson line, thence N0. 50 E 45 Chains 70 links to a stake. thence So 40 E 9 chains 80 links and thence So 20 W 24 chains to the beginning, which Seventy six acres of land is part of 150 Acres of land granted to the said Daniel Richardson bearing date the fifth day of July 1774. TO HAVE AND T0 HOLD the aforesaid seventy six acres of land with the appurtenances and all rights priviledges and improvements to the same in anywise belonging to the'same in anywise belonging to the said Jonathan Clyatt .his heirs and assigns forever to the only proper use benefit and behoof of him trie said Jonathan Clyatt his Heirs and assigns; forever, and the said Daniel Richardson for himself his heirs and assigns doth hereby" covenant and agree to and with the said Jonathan Clyatt, that he the said Jonathan Clyatt his heirs and assigns shall and may forever hereafter peaceably and quitetly have hold occupy possess and enjoy the afore granted seventy-six acres 0f land and premises without the let molestation of any persons whatsoever and Free and clear from all manner of incumbranees whatever, and the said Daniel Richardson for himself his heirs executors administrators and assigns, doth forever further covenant and agree to and with the said Jonathan Clyatt that if one person or persons by any pretention of a right or Title from under the said Daniel Richardson his Heirs executors Administrators or assigns, shall at any time hereafter being a suit in law or equity against him the said Jonathan Clyatt his Heirs or assigns for the abovesaid Seventy Six Acres of land & premises that the said person or persons then forefeits his or their rights of the above said land & premises to the said Jonathan Clyatt his Heirs or assigns, and also pay the said Jonathan C'lyatt his heirs or assigns the just & full sum of ten pounds current money of Georgia the same being the consideration money mentioned in the above written indenture, and the said Daniel Richardson doth oblige himself his Heirs Executors and administrators to Warrant & defend the afore granted premises to him the said Jonathan Clyatt his Heirs & assigns forever, against the claims of all persons whatsoever.
