MORGAN, Merchant of the City of Augusta of the state aforesaid on the other part, witnesseth that the said James Collen (not completely sure on the middle name as this is difficult to read but could be one of the few places the middle name was spelled out) MORGAN in and by his certain five promissory notes bearing ? dates with these presents and payable on the first January 1826, 1827, 1828, 1829, 1830 stands indebted to the said Joseph GANAHL of the city and state aforesaid in the sum of fifteen hundred dollars as by reference to the said notes will more fully appear; and copies of which notes are affixed in the margin of this indenture. Now this indenture witnesseth that the said James C. MORGAN of the city and state aforesaid for and in consideration of the said debt, or sum of fifteen hundred dollars and for the ? securing the payment thereof with the interest that may accrue thereon, according to the ? and effect of the said five notes and ? for and in consideration of the further sum of ten dollars to him in hand will and truly paid by the said Joseph GANAHL at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, as well as for securing the payment of the aforesaid sum, hath granted, bargained, sold, conveyed and confirmed and by these presents, doth grant, bargain, sell, convey and confirm unto the said Joseph GANAHL of the city and state aforesaid his heirs and assigns. All those two adjoining lots or parcels of land, situate lying and being in Milledgeville in the county of Richmond in said state, containing six acres and six tenths of an acre more or less, bounded on the west by the road, which divides said lots hereby conveyed and MILLEDGE'S land on the south by CARMICHAEL and on the east and north by MILLEDGE'S lands, as by reference to the deed from David McKINNEY & WIFE to John GINDRAT and from John GINDRAT and wife to Joseph GANAHL and from Joseph GANAHL and wife to James C. MORGAN and the plat annexed will mroe fully appear. To have and to hold the said bargained lots or parcels of land, and every part thereof, unto the said Joseph GANAHL his heirs and assigns, to his and their own proper use, benefit and behoof forever. Provided always and it is the express understanding of the parties, and the true intent and meaning of these presents that if the said James C. MORGAN, his heirs, executors or administrators or either of them shall well and truly pay unto the said Joseph GANAHL the aforesaid sum of fifteen hundred dollars on or before the maturity of the said promissory notes aforesaid then and from henceforth as well this present indenture and the right to the propterty hereby conveyed as the said promissory notes and every matter and thing therein contained shall cease and be void and of no effect, anything herein contained to the contrary thereof notwithstanding.
