Witnesseth, that for and in consideration of the sum of twenty-five pounds lawful money of the said state to them, the said Thomas & his wife Elizabeth, or either of them, in hand at and before the sealing and deliver of these presents by the said George RANDOLPH well and truly paid, the receipt whereof, the said Thomas MORGAN & Elizabeth do hereby acknowledge and thereof, and every part and parcel thereof do acquit, release, exonerate and discharge the said George RANDOLPH, his heirs, executors and administrators and every of them forever by these presents, they the said Thomas MORGAN & Elizabeth his wife have granted, bargained, sold, acknowledged and confirmed, and by their presents do fully, freely, clearly and absolutely grant, bargain, sell, ? release and confirm unto the said George RANDOLPH in his actual possession, now being by virtue of a bargain and ? to him thereof made by the said Thomas MORGAN for one whole year, for the consideration of five shillings lawful money aforesaid, by an indenture of case bearing date the day next before the day of the date of these presents to commence from the day next before the day of the date hereof, and seals and delivered before the executing of these presents, and also by force of the statutes for transferring of uses into possession in that case made and provided, and unto his heirs and assigns forever. All that town lot in the town of Augusta, in the state of Georgia known by the number thirty-nine, and bounded as appears by a certificate annexed to the original grant thereof, duly recorded in the registers office for the said state. Together with all and singular the gardens, orchards, fences, ways, wills, waters, water-courses, easments, profits, common? -ties, advantages, envolvements, heri?mints, and appr? tenances, whatsoever, to the said town lot, belonging or in anywise appertaining and the revision and revisions, remainder and remainders, rents, ? profits thereof, and of every part and parcel thereof and also all the estate, right, title, ?, possession, property, profit, claim and demand whatsoever either in law or equity which they the said Thomas MORGAN & Elizabeth his wife, now have or ever had, or which they or their heirs hereafter shall, may, can or ought to have of, in, ? or out of the said town lot and other the presentes with their and every of their appe?tenances. Together with all deeds, plats, grants, charters, writings and m?ments whatsoever which they the said Thomas MORGAN & Elizabeth his wife now have in their custody or possession or can come by without suit at low or equity that do only concern the premises. To have and to hold the said town lot, number thirty-nine and all and ? the premises, hereby granted and released or means or intended to be granted and released unto the said George RANDOLPH, his heirs and assigns to the only proper use and behoof of the said George RANDOLPH, his heirs and assigns forever and the said Thomas MORGAN for himself, his heirs the said premises hereof bargained, sold, granted, ? as ? ? to be bargained, sold, granted and released with their and every ? their app? ances unto his heirs, exors and administrators, doth covenant, promise, grant and agree to and with the said George RANDOLPH his heirs and assignes, by these presents, in manner and form following that is to say that he the said Thomas MORGAN now at the time of the ? and delivery of these presents is and standeth lawfully and absolutely ? of and in the said town lot in the town of Augusta and all and singular other the premiese herein before mentioned and intended to be hereby granted and released and every part and parcel thereof with ? and every of their app?tenances of a good, sure, perfect and absolute estate of inheritance in fee simple, without any manner of condition, trust, pro?, power of revocate an or limitation of any use or uses, or other restraint, matter of thing, whatsoever, to alter, change, charge, defe? with the same, and also that the said Thomas MORGAN now hath in himself, good right, full power and also lawful and absolute authority, to grant, release, and confirm the said town lot and all and singular the premises herein before mentioned and intended to be ? by granted and released and every part and parcel with their and every of their app?tenances, unto the said George RANDOLPH, his heirs and assigns forever as aforesaid and also that it shall and may be lawful to and for the said George RANDOLPH his heirs and assigns, from time to time, and at all times forever, hereafter, peaceably and ? to enter into and have hold, occupy, possess and enjoy the said town lot and all and singular the (a word written above looks to be "other") premises herein before mentioned and intended to be hereby granted and released and every part and parcel thereof with their and every of their app?tenances without any the lawful lot , suite, trouble, molestation, eviction or interuption of the said Thomas MORGAN his executors or administators or any other person or persons whatsoever claiming or to claim by, from or under him or them, and that free and clear and ? and clearly and absolute by acquited, ? and discharged of and from, all, and all manner of ? and other gifts, grants, bargains, sales, uses, wills, ?, ?, dowers, judgements, executions, charges and incumbrances whatsoever had made done, c? or suffered by the said Thomas MORGAN or any other person or persons whatsoever, lawfully claiming or to claim by, from or under him and lastly that the said Thomas MORGAN and his heirs and all and every other person and persons, lawfully claiming or to claim any estate, right, will, trust or interest of ? ? the said town lot and all and singular other the (promises or premises) herein before mentioned and intended to be hereby granted and released, or any part or parcel thereof, shall and will from and at all times hereafter, at the reasonable request and proper cost and charges in the ? of the said George RANDOLPH his heirs and assigns, made, as, acknowledge & execute or cause and procure to be made, done, acknowledged and executed all and every such further and other lawful and reasonable act and acts, thing and things, conveyances and assurances, in the law whatsoever for the further, better and more perfect and absolute granting, conveying and assuring? the said town lot and all and singular other the premises herein before mentioned and intended to be hereby granted and released, and every part and parcel thereof, with their and every of their app?nances, to and for the use and behoof of the siad George RANDOLPH his heirs and assignes forever, as by him or them, or by his or their counsel ? in the law shall be reasonable ? and ?
