Not withftanding the total difappointment of the corn mentioned in the body of the warrant, proceedings, illegal were ftill carried on, which produced the following deposition: GEORGIA} Wafington county} BEFORE me, John Watts, Esg., a juftice of the Peace for the faid county perfonally appeared John Bugg, and being duly fworn upon his oath declared, That a Samuel Hicks came to the houfe of this deponent, then refiding in the county of Wilkes, and made a tender of an inftrument of writing, fuppofing to be an old deed made from this deponent to Jacob Caftleberry, for 200 acres land lying on the waters of the Big Kioka creek, originally granted this deponent, which deed was much obliterated and defaced, faying his brother Edmond Bugg Hicks had purchafed the faid land: and afked this depouf he did not fell the faid Caftleberry, his land, who anfwered in the affirmative. That the faid Samuel Hicks, replied, that his brother, Edmond Bugg Hicks had bought the faid land and not knowing that the faid Samuel Hicks came with a palpable and notorious lie in his mouth did though with great reluctance, in a wicked and fraudulent manner obtain from this deponend a title for the aforefaid two hundred acres of land, not withftanding he well knew the right lay to another perfon.
