Coleman, 1858, Augusta, Richmond County, Georgia. James L. Coleman _______________ In the Name of God, Amen! I, James L. Coleman, of the County of Richmond and State of Georgia, being of or in good bodily health and of sound and disposing memory, do make, publish and declare this my last will and testament, revoking all others. Imprimis. I do not wish to have any part of my property sold to extinguish my debts, seeing no necessity for it under the management of my friends, Thomas Dunegan, Jas. W. Daives and Wm. A. Walton. The income from it will be sufficient to relieve it in a couple of years, if conducted as I leave it, and therefore empower my Executors to pledge the whole, or any part thereof under mortgage to concentrate my debt. Item: It is my wish under the management of Thomas Dunegan, my business continue as it is, my other Executors paying attention to and assisting him in his accounts. He the said Dunegan being paid ($700) Seven Hundred Dollars pr annum for his services and no commissions, or become equally interested in the business if he chose. Item: So soon as my debts are paid, I wish my Executors to pledge my whole estate for means to erect a first class merchant mill, on my mill lot East of the Augusta Machine Works, to be delivered up to the sole management of the said Thomas Dunegan. The profits arising therefore to remain in the hands of the said Thomas Dunegan, to be considered joint funds of the said Thomas Dunegan and my two youngest children, Sarah Anna Coleman and Lindsay Coleman, till it accumulates to (20 thousand) Twenty Thousand Dollars as capital for the mills operations. Beyond that amount an annual division to be made between the said Dunnegan and my two younger children as above named. Item: in consideration of the care and kindness bestowed on my children while raising by Mrs. Alpha Rodgers, I direct my Executors should her circumstances require it, to pay her from time to time such sums of money, or to her child or children, from my estate as they consider proper and necessary, and I leave such payments to their discretion. Item: Whatever part of my estate may be assigned to my daughter, Sarah Anna, I direct to be secured to her sole and separate use, independently of any future husband, and if she die without issue, at the time of her death, son Lindsay - or in the event of his decease, then all of the property willed both to his sister and himself be and become the property of the orphans under the benefaction of the late Isaac Tuttle, or in other words go to the aid of that institution. Item: It is my desire that application be made to my sister, Mrs. Mary Warren, on my demise, my estate having been so crippled up, for means to send my son Lindsay off to school. I have the very strongest claims on her, having in all instances backed her husband, to enable her to rear and educate her own children. I wish him sent to Europe to be educated, where he cannot breathe the tainted atmosphere of a Twiggs, till he becomes 21 years of age. Item: It is my will and desire that my Executors, and I press it on my friend, Thos. Dunnegan, publish all my letters to Mrs. Geo. L. Twiggs, wife of the late Major Geo. L. Twiggs, and to Mrs. Coleman, urging both of them not to destroy my family but to unite them, disregarding which they have shown themselves to the world to be possessed of the most callous heart ever implanted in the breast of human beings. Item: It is my will and desire that all my property be equally divided between my son Lindsay and my daughter Sarah except Item: From the base and infamous conduct of my two oldest sons, John and Henry, I give them as little as the law allows me (5.00) five dollars each, and consign them over to George W. L. Twiggs' company and the Twiggs Family severally. Finally I appoint my friends Thomas Dunnegan, James W. Davies and Wm. A. Walton, Executors of this my last will and testament. In witness I have hereunto set my hand and seal this ?????? in the year of our Lord, Eighteen Hundred and Fifty Eight. Signed, Sealed, Published and Declared by James L. Coleman as his last will and testament, in presence of J. A. Christian, Benj. F. Hall, W. G. Whidby. Additional Comments: James L. Coleman was the husband of (1) Lucy G. W. Bacon (abt.1810-1830) & (2)Emmeline Ruth Twiggs (abt.1812-1884).
