ERGLE, of said State and County, being of sound and disposing mind and memory, make this as my last will and testament, hereby revoking all former wills by me heretofore made. (1) All just debts to be paid as soon as practicable after my death. (2) I appoint my beloved husband, JOSEPH L. ERGLE, Executor of this will, hereby relieving him from giving bond, filing inventory, or making returns of any kind to any Court . I empower him, as such Executor, to sell or otherwise dispose of the whole or any part of my estate, real or personal, publicly or privately, without advertisement, and without order of Court for any purpose whatsoever. (3) I give, divise and bequeath to my said husband, Joseph L. Ergle, all my property, real and personal, of whatsoever consisting and wheresoever located. Coffin who being duly sworn, says that he is one of the subscribing witnesses to the foregoing instrument of writing dated the 10 day of December A.D. 1936, purporting to be the Last Will and Testament of Mrs. Maggie M. Ergle. That he (deponent) together with George A. Briggs and C.A. Dennis subscribed their names to said instrument of writing, as witnesses at the special instance and request of the said Mrs. Maggie M. Ergle and in her presence, and in the presence of each other: That the said Mrs. Maggie M. Ergle in the presence of Deponent, and the said George A. Briggs and C.A. Dennis freely and voluntarily signed and published said instrument of writing as her Last Will and Testament, and at the time of said signing and attestation, the said Mrs. Maggie M . Ergle respectfully shows: 1st That he is a resident and citizen of said State and County, and of lawful age. 2nd That Mrs. Maggie L. Ergle of said County departed this life in said County on the 16th day of February A.D. 1937, after having made and duly executed her last Will and Testament here to the court shown. 3rd That your petitioner is nominated the Executor of said Will. Your Petitioner produces said Will in Court, and prays that the same may be proved and admitted to record in common form, and that Letters Testamentary issue to your Petitioner is terms of the law.
