All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm *********************************************** Will of James Toole, Richmond County, Georgia Will Book 2, pgs. 369-371 transcribed by Cheryl Aultman from microfilm, Jan. 2003 In the name of God Amen, I James Toole of Mount Claire in the County of Richmond & State of Georgia being of sound mind & disposing memory tho feeble in body & declining in strength & health and in considering also the uncertainty of all temporal events & the certainty of death; and being desirous to make such disposition of my property as may by the blessing of Almighty God be useful to my surviving family & heirs, I do make this my last will & testament the day & year hereinafter written. Item First; I do hereby give & bequeath to my son James Toole my Lot of Land containing two hundred two & half acres known as number one hundred & eleven (No. 111) in the Eleventh (11) District Muscogee County in sd. state; Also one negro man slave named Lundy: I do confirm to my son James & his heirs or assigns my right to the following negroes formerly given to him viz, old Tom, Sall (?), Phoeba, Tilly & Collin. Item second; I give and bequeath unto my grand children John T. Holt, Alfred C. Holt, David R. Holt, Clara N. Holt and Lucy S. Holt, the children of my daughter Harriet N. Holt the following named Eleven negro slaves viz, George & his wife Mary & their children Moses, Jack, Henry, Polly & Sally; also Betty & her two sons Davy & Robert, also Jinney together with their future issue & increase; all which negroes I desire shall remain in the possession of my Daughter Harriet N. Holt for the use of herself and my said grandchildren until the youngest of them shall be of age and then the said negro slaves that may be ____ with their future increase must be divided equally among my before mentioned grandchildren the children of my daughter Harriet N. Holt that may be then alive share & share alike. Item Three, I give & bequeath to my Grandchildren James Jeremiah Toole, Harriet Mary Toole, William Toole, John Toole & Susannah Toole the children of my son George W. Toole Eight negro slaves & their future increase as follows, Tom & his wife Nancy & their children Lucy, Charlot, Cesar, Reuben, Patsey & Jinney which negroes I desire & wish to be kept together or hired out as circumstances may require for the use of my said Grandchildren the children of my son George W. till the youngest of them shall come of age & then the said negroes that may be alive together with their future issue must be divided among my last named Grand children equally share & share alike: I also give & bequeath to my son George W. Toole my Lot of Land containing four hundred & ninety acres known as number forty two (No. 42) in the seventh (7th) district of Irwin County in sd. state. Item Fourth, I give & bequeath to Mrs. Susannah Cumming my Girl Sarah. Item fifth, I give & bequeath to Eliza Murrew my Girl Amy. Item sixth & last, I give & bequeath to my wife Susannah the following property viz; old Jack, Mime (?), Ned, Dublin, Jacob, Harry, Natty & her children Betty, Judy & Milly, also old Nancy, Maria & her children Ida, Delia & Fanny - also my House & Plantation called Mount Claire together with all my furniture of every sort, also my carriage, Gig & Horses together with all my cattle & the stock & plantation tools and all other property not hereinbefore divided of which I may be possessed or to which I may have any right at the time of my death to do with & dispose of as she may think proper. I hereby constitute and appoint my beloved wife Susannah Toole my Executrix to this my last will and only will & Testament informing & requiring of her to fulfill my desires accordingly and to defray my funeral expenses. Shackelford Georgia, Richmond County, Personally appeared before us David Reid, who being duly sworn saith that he was personally present and did see James Toole sign, seal, publish and declare the within instrument of writing to be his true last will and Testament and that he together with Robert A.
