All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm *********************************************** Will of Susannah Toole, 1834 Richmond County Georgia, Will Book 3, pg 31-34 transcribed by Cheryl Aultman from microfilm records, Jan 2003 In the name of God Amen, I Susannah Toole, widow of James Toole, late of Richmond County Georgia, being of sound disposing mind & memory do hereby make this my last will and Testament revoking any & all former wills by me made. Firstly, I give & bequeath my negroes Jack, old Nancy, Harry, Maria,Ned, Jacob, Fanny with her future increase, Delia and her child Hannah with their future increase to my daughter Elizabeth Reid, widow of the late David Reid of said county, conditioned that my funeral expenses shall be paid by my said daughter & after my death she shall be at liberty to sell or otherwise dispose of said negroes & the increase of the females, or at her death will them to whom she pleases if it should so happen that I should be (a word crossed out here) the owner of said negroes at the time of my death. But secondly my will & desire is that my grandson Robert A. Reid should as soon as a proper purchasor shall offer, sell the negroes Ned, Jacob, Fanny, Delia and her child Hannah for the best price he can obtain and place the amount at interest in some secure way, payable half yearly to meet my personal expenses & support old Jack & Nancy as long as they and I may live, and after my death the proceeds of said sale which may be due as well principal as interest shall become the property of my said daughter Elizabeth Reid & be at her disposal in the same manner as the negroes would have been if no sale had been made. Old Nancy & Jack to be supported by my said daughter as long as they may live or require aid from my estate. Thirdly, If my daughter Elizabeth Reid should die before me & without a will or surviving me should die without making any disposition by will or otherwise then I desire my Executor hereafter named to make the same disposition of the property as my daughter could do under this will and to divide the proceeds equally amongst the children of said daughter viz; Robert A. Reid & David Reid, my grandsons & Elizabeth R. McDowell & Susannah M. McDowell children of my granddaughter Anna McDowell, deceased, formerly Anna Reid, share & share alike. Fourthly, I give without condition my negroes Jack, old Nancy, Harry and Maria with the future increase of Maria to my daughter Elizabeth Reid, to be her property her heirs and assigns forever as far as regards Jack & old Nancy to be subject to the provisions in their behalf already stated. Lastly, I do hereby constitute & appoint my grandson Robert Alexander Reid of Augusta Georgia Executor of this my last will & Testament. Witness my hand & seal on the sand hills near Augusta Georgia this twenty fifth day of October in the year of our Lord Eighteen hundred and thirty four (1834). Cumming a subscribing witness to the within instrument of writing purporting to be the last will & testament of Susannah Toole, late of Augusta in the State aforesaid dec'd. who being duly sworn deposeth and saith that he was present and did see the said Susannah Toole sign, seal, publish and ........................................... Letters testamentary were granted to Robert A. Reid, the Executor named therein on Monday 7th September 1840 at a Court of Ordinary held in Richmond Co., GA.
