They met in the road about eight miles south of Covington, and the difficulty arose about a steer that Simpson had bought from Kelly and failed to pay for. Kelly was the father of Charles Kelly, who is now working out a life time sentence to Dade coal mines for the murder of W. H. Hardeman, who was assassinated in Newton County ten or fifteen years ago, while sitting in his door one summer evening. The old man was arraigned and tried as an accomplice at the same time Charles was convicted, but the jury made a mistrial, and the case was dismissed.
