Denard of said county, do this day make ordain and publish and declare this to be my last will and testament, and hereby declare all other will heretofore by me made to be null and void. Item 1st It is my will and desire that all my just debts be paid by my executor and executrix as soon as practicable after my decease. Item 3 It is my will and desire that my beloved wife Kansada Denard have and keep all of my property real and personal together and manage it as she may think best so to do for the support and maintenance of herself and the maintenance and education of the youngest children while they stay with her, and during her lifetime, and after he death, I desire all my property to put up and sold to the highest bidder and the proceeds to be equally divided amongst all my children ti wit: Martha Ann Peek, John F. Denard, James M. Denard, Sanford Denard, Mary Wade, Melvina Denard, Eugenia Denard, Jefferson D. Denard, George W. Dennard, Ellen Jane Elllington, and Charles Denard. Each of my children to have an equal share of the proceeds of my estate. Item 4 I give and bequeath to my daughter Eugenia Denard in trust for the sole and separate [sic] use and benefit and advantage of my son Sanford Denard all that portion of my estate that may be coming to him upon an equal division of my estate and that have no control over it no further than the said Eugenia Denard may allow him to have and that portion of my estate that comes into the hands – the said Eugenia Denard as trustee for my son Sanford Denard, shall never be subject to, nor never be taken to pay any debts that he has ever made, or that he may ever make only so far as the said Eugenia Denard may see proper to pay out of his said trust funds. Item 5 James M Denard having received from me two hundred and ninety one dollars for which I am now holding his notes and if he pays off them notes, I desire for him to share equal (share) with all the rest of my children but in the event the notes are not paid the amount of the notes is to be counted against him as an advancement made to him and that he draws nothing from my estate until all the rest of my children have been made equal with him before he shall be entitled to draw anything from my estates. Item 6th I hereby appoint and constitute my beloved wife Kansada Denard my executrix and Jefferson D. Dennard my executor to this my last will and testament. In witness whereof I hereunto set my hand and fix my seal this 24th day of January 1890. Thomas W. He was a son of John Dennard (b ~1794, d 1856) and Mary Ann Almand (b 1803, d after 1870). All the children named in the will are all the known children of Wash and Kanzada. They are buied in the Almand Cemetery in Rockdale County, Georiga.
