Cottle to bill of complaint of Sa?? Sor??? & Ansel Beckwith complaints. The defendant now and at all times hereafter reserving unto himself the usual benefit of all advantage and exception answering saith: That in ad??ter that he did on the 30th day of Jany 1878 purchase of El. V. Cottle one hundred and sixty acres of the land formerly owned by Ebenezer J. Cottle late of said county deceased. that he paid her the sum of six hundred and forty dollars for the same and that on the 30th day of (blank) 1878 the said Eldora made and executed a deed to him for said land which is hereto marked exhibit A which defendant asks be made a part of this answer with usual ???? of reference thereto. The defendant desires all manner of collu??? with the said Eldora V. Cottle, Aaron T. Hart and his co-administrator to cheat and defraud or render liable the complaints as security on the administrators bond, but avers and asserts that he purchased the said land of the said Eldora in good faith, that he is now and has been since this time of purchase in possession of same. All which matters and things the defendant is ready and willing to aver, maintain and prove as the court shall direct and pray to be herein discussed (?) with his reasonable cost & charges in this behalf most wrongfully sustained. Cottle do solemnly swear that the facts setforth in this answer so far as they relate to his own acts and deeds are true of his own knowledge and so far as they relate to the acts of others, he believes them to be true. This indenture made the 30th day of January in the year of our Lord, one thousand eight hundred & seventy nine between Eldora V. Cottle of the state of Georgia and county of Marion of the first part and G (or Z) B. Slade & C.A. Ethridge, co-partners using the firm name of Slade & Ethridge of the state of Georgia and county of Muscogee of the other part. Witness that the said Eldora V. Cottle for and in consideration of the sum of Twelve hundred dollars to her in hand paid at and before the sealing and delivering of this presents (the receipt whereof is hereby acknowledged hath granted bargained sold & conveyed to the said Z(?) B. Slade & C.A. Etheredge their heirs & assigns all that tract in parcel of land situated lying and being in the thirtieth (30) district of Schley County and knowed as Lot No. (202) Two hundred two containing (202 1/2) two hundred two one half acres more or less, one hundred & twenty acres (120) of Lot No. (201) two hundred one, one hundred & fifty acres of Lot No. (214) two hundred fourteen, One hundred & ninety (190) acres of Lot No. (215) and fifty acres of Lot No. (235) in all seven hundred (700) acres more or less. To have and to hold said bargained premises unto them the said Z.B. Slade & C.A. Ethredge, their heirs and assigns together with all the singular the rights members and appurtenances thereof to the same in any manner belonging to them and their own proper use benefit and behoof in fee simple and the said Eldora V. Cottle for her heirs executors & administrators the said bargained premises unto the said G(?) B. Slade & C.A. Etheredge their heirs and assigns will warrant & forever defend the right and ???? thereof against herself and against the claims of her heirs, executors, administrators and assigns and against the claims of all other persons whatsoever & testimony whereof the said Eldora V. Cottle hath hereunto set her hand and affixed her seal the day and year first above written. Signed, sealed and delivered in presence. E.V. Cottle Recorded January 31st 1879 Gorgia, Schley County T.G. Chaney (Cheney), D. Clark in person appeared before the undersigned. A.J. Hart, who after being duly sworn deposes & says that he saw Mrs(?) Eldora Cottle sign the within deed and signed the same as a witness with John Hanner and saw John Hanner sign said deed of conveyance to G.B. Slade & C.A. Ethridge.
