Weaver MtnMaJane@webtv.net October 20, 2007, 10:00 am Lot 130/Dist. 29 Written: September 6, 1869 Recorded: January 7, 1870 GEORGIA SCHLEY COUNTY Whereas Joseph Mott of said county, administrator of Isaac Eubanks, late of said county, deceased, did on the sixth day of September in the year of our Lord, Eighteen Hundred Sixty-nine, commence the publication of a notice in the Sumter Republican to all concerned that at the expiration of sixty days from that date, said Joseph Mott administrator as afore said would apply to the honorable court of Ordinary of Schley county when sitting for ordinary purposes, for leave to sell half lot of land number one hundred & thirty in the twenty-ninth district of Schley county, a part of the real estate of said deceased. And whereas there being no objection made to said application, the said court did on the first day of November in the year of our Lord, eighteen hundred and sixty-nine, pass an order granting leave to said Joseph Mott, administrator, as aforesaid to sell said half lot of land and whereas in pursuance of said order and after the publication of the notice of sale in the Sumter Republican for sixty days, said Joseph Mott, administrator as aforesaid, did on the first Tuesday in November in the year of our Lord, eighteen hundred and sixty-nine, at the court house door at Ellaville in said county between the lawful hours of sale, put up at public outcry, said half lot of land, and whereas Harrison Holloway of said county, being the highest and best bidder, said half lot of land was knocked off to him at and for the sum of Twelve Hundred and Thirty dollars. Now this indenture, made and entered into this the second day of November in the year of our Lord, Eighteen Hundred and Sixty-nine, between Joseph Mott, administrator of the estate of Isaac Eubanks, late of said county, deceased of said county, on the one part and Harrison Holloway of said state and county, of the other part. Witnesseth that for and consideration of the sum of twelve hundred and thirty dollars, cash in hand, paid by the said Harrison Holloway, the receipt whereof is hereby acknowledged, the said Joseph Mott, administrator as aforesaid, doth by these presents bargain, sell, alien and convey, as far as his authority as administrator as aforesaid will warrant him, unto the said Harrison Holloway all that west half of lot of land, situate, lying and being in the twenty- ninth district of Schley county, known and distinguished in the plan of said district as the number one hundred and thirty, containing one hundred one & one fourth acres, agreeable with the original survey, be the same, more or less with all the rights, members and appurtenances to said west half lot of land in any wise appertaining or belonging, to have and to hold the said west half of lot of land, with all its appurtenances unto him the said Harrison Holloway, his heirs, executors and administrators, will warrant and defend against himself his heirs and executors and administrators and against all other persons whatever. In testimony whereof the said Joseph Mott, administrator as aforesaid, hath hereunto set his hand and affixed his seal, the day and year first above written. Bivins, Clerk Additional Comments: This document bears 3 "Fifty Cents" Conveyance documentary stamps in excellent condition. Written across the stamps in pen and ink is the date Nov. 18, 1869. In the 1860 Macon Co. census, GMD 740, Isaac Eubanks, age 77, is found living next door to Joseph Mott, age 56. In Joseph Mott's household is a 38 year old female named Sarah. I believe this to be Sarah Eubanks Mott, daughter of Isaac Eubanks and second wife to Joseph Mott.
