Banks of said State and County, desiring to avial himself of the Pension Act (Section 1254, Code), hereby submits his proofs, and after being duly sworn true answers to make to the following questions, deposes and answers as follows: 1. What is your name and where do you reside? William Abner Banks, Ellaville, Schley County, Ga. 2. How long and since when have you been a resident of this state? since my birth in 1845 3. When and where were you born? July 2nd 1845 in Muscogee Co., Ga. 4. When and where and in what company and regiment did you enlist or serve? In April 1864, at Columbus, Ga. in Company F, 5th State Reserves. Capt. James Jarrett, was mustered into service in Macon, Ga. 5. How long did you remain in such company and regiment? Until the close of the war 6. When and where was your company and regiment surrendered and discharged? the company & regiment was discharged in South Carolina, was mustered in in Macon, stayed with company there about 9 months, then went to Atlanta & when Atlanta fell, we fell back to ?Griswoldville & (unreadable) ok pneumonia & was sent to Macon hospital. 7. Were you present with your company and regiment when it was surrendered? No 8. If not present, state specifiacally and clearly where you were, when you left your command, for what cause and by whose authority? I was left in the hospital in Macon, Ga. (Floyd House) when Macon fell, I was transferred to Geneva, Ga. & there captured by Wilson Raiders & paroled in LaGrange, Ga. 9. How much can you earn per annum by your own exertions or labor? Nothing 10. What has been your occupation since 1865? Feeble but able to do some work 11. Upon which of the following grounds do you base your application for pension, viz: first, "age and poverty," second, "infinity and poverty," or third, "Blindness and poverty"? Infirmity & poverty. 12. If upon the first ground, stste how long you have been in such condition that you could not earn your support? If upon the second, give a full and complete history of the infirmity and its extent? If upon the third, state whether you are totally blind and when and where you lost your sight? My occupation has been that of a miller but am ruptured, caused by a fall off the stockade at Macon, Ga. My bowels drop down and I can not work. Also dispepsia & b????? affection. 13. What property, real or personal, or income, do you possess, and its gross value? nothing at all 14. What property, real or personal, did you possess in 1894, 1895, 1896, 1897, 1898, 1899 and 1900 (1901 & 1902 written in by hand) and what disposition, if any, by sale or gift, have you made of same? In 1894, 1895, 1896 & 1897 about $500.00, in 1898 $250.00, in 1899 $100.00, 1900 $50.00, in 1901 I had all my corn & peanut (?) farming tools burned up, which left me nothing. 15. In what county did you reside during those years and what property did you then return for taxation? In 1894, 1895, in Fayette Co. $500.00 in 1896 & 1897 in Martin (looks like) $400.00, in 1898 in Stewart Co. $250.00, in 1899 in Schley County $100.00, 1900 in Schley $50.00, 1901 $150, in 1902 nothing. 16. How were you supported during the years 1899 and 1900? Run a little farm on shares in 1901, but can do no work now. 17. How much did your support cost for each of those years, and what portion did you contribute thereto by your own labor or income? I had to use part of my property by selling to live. I did not make a support. 18. What was your employment during 1898 and 1899? What pay did you receive in each year? Run a little farm on shares, did not make expenses. 19. Have you a family? If so, who composes such family? Give their means of support? Have they a homestead? A wife, no children. She is 54 years old. Have no means of support. 20. Are you receiving any pension? If so, what amount and for what disability? No 21. Have you ever made an application forpension before? Yes 22. Johnson, of said State and County, having been presented as a witness in support of the application of Wm. A. Banks fro pension under Section 1254, Code, and after being duly sworn true answers to make to the following questions, deposes and answers as follows: 1. What is your name and where do you reside? Atlanta, Ga. 2. Are you acquainted with Wm. A. Banks, the applicant; if so, how long have you known him? About 39 years 3. Where does he reside and how long and since when has he been a resident of this state? Schley Co., Ga. Ever since I knew him. 4. When, where and in what company and regiment did he enlist, and how do you know? Co. F, 5th Reg. State Reserves. 5. Were you a member of the same company and regiment? Yes, I was 2nd Lieutenant. 6. How long did he perform regular military duty? Twelve months 7. When and where was his command surrendered? in South Carolina 8. Were you present when it surrendered? No 9. Was applicant present? No 10. If he was not present, where was he? (the following is lined out) He was taken sick at Griswoldville with pneumonia. When did he leave his command? (lined out) in Spring 1865. For what cause? (lined out) pneumonia By what authority he left? (lined out) By D. Clark, surgeon of the regiment. How do you know all of this? (lined out) I was 2nd Lieut. 11. What property, effects or income has the applicant? Do not know 12. What property, effects or income did the applicant possess in 1896, 1897, 1898, 11899 and 1900, and what disposition, if any, did he make of same? Do not know 13. Has he conveyed away any of his property in the last four years, if so, what was it, and to whom? do not know 14. What is the applicant's occupation and physical condition? dod not know 15. Is the applicant unable to support himself by labor of any sort, if so, why? Do not know 16. How was he supported during the years 1898, 1899 and 1900? Do not know 17. What portion of his support for these three years was derived from his own labor or income? do not know 18. Give a full and complete statement of the applicant's physical condition that entitles him to a pension under section 1254, Code? do not know 19. Wilkinson, Ordinary, Fulton County. AFFIDAVIT OF PHYSICIANS State of Georgia Schley County Personally came before me C.G. Jones & W.D. Sears, both known to me as reputable physicians of said county, who being severally sworn, say on oath that they have examined carefully Wm. A. Banks, applicant for pension under Section 1254, Code, and after such personal examination say that his precise physical condition is as follows: He is badly ruptured. He suffers with (unreadable) trouble which makes him constantly cough & he also suffers with dispepsia. He is physically unable to do any manual labor, & there is no hope of any improvement in his condition. They further say on oath that the physical condition of applicant renders him unable to labor at any work or calling sufficient to earn a support for himself, and that we have no interest in said pension being allowed. QUESTIONS FOR WITNESS State of Georgia Schley County William Allen Banks of said state and county, having been presented as a witness in support of the application of Wm. A. Banks, for pension under section 1254, Code, and after being duly sworn true answers to amke to the following questions, deposes and answers as follows: 1. What is your name and where do you reside? William Allen, Schley County 2. Are you acquainted with Wm. A. Banks, the applicant; if so how long have you known him? About five or six years 3. Where does he reside, and how long and since when has he been a resident of this State? Schley Co., Ga. & has ever since I knew him 4. When, where and in what company and regiment did he enlist, and how do you know? do not know 5. Were you a member of the same company and regiment? No 6. How long did he perform regular military duty? I do not know 7. When and where was his command surrendered? do not know 8. Were you present when it surrendered? No 9. Was applicant present? I do not know 10. If he was not present, where was he? do not know When did he leave his command? do not know For what cause? do not know By what authority he left? do not know 11. What property, effects or income has the applicant? He has nothing but a little household furniture of about $50 in value 12. What property, effects or income did the applicant possess in 1896, 1897, 1898, 1899 and 1900, 1901, and what disposition, if any, did he make of same? He run a little farm on shares near here in 1899, 1900 & 1901. He had no stock & was not worth more than $250.00. 13. Has he conveyed away any of his property in the last four years, if so, what was it, and to whom? He has not conveyed his property, has gradually sold it off to live. 14. What is the applicant's occupation and physical condition? He is very feeble & suffers with rupture, also dispepsia & a bad cough. He has no occupation now & is not able to work. 15. Is the applicant unable to support himself by labor of any sort, if so, why? He is very feeble & not able to walk some time. He is confined to his home (which is rented at $3.00 per month). 16. How was he supported during the years 1898, 1899, 1900 and 1901? 1901 partly by his own labor & partly by a cousin who let him have a little money. 17. What portion of his support for these three years was derived from his own labor or income? I suppose one fourth--3/4 from charity. I know this of my own knowledge. 18. Give a full and complete statement of the applicant's physical condition that entitles him to a pension under section 1254, Code? He is very feeble, wan & not able to stand upon his feet for any length of time. He has to walk with a stick for support. 19. What interest have you in the recovery of a pension by this applicant? None whatsoever, I was with Co. G, 5th Ga. William Allen Banks, witness Sworn to and subscribed before me, this the 5th day of May 1902 Phil E. Taylor, Ordinary. (Notes: It is apparent to me that this witness is actually William Allen, not William Allen Banks. The surname Banks was added in two places to the William Allen signature, it would appear after the fact. I one place the surname Banks was not added. The handwriting and ink color appear slightly different in thos instances. Also, William Allen did serve in Co. G, 5th Ga.) LETTER FROM PHIL E. TAYLOR State of Georgia Office of Court of Ordinary Schley County, Ga. Ellaville, Ga., Dec 22, 1902 J.W. Lindsay, Com. Pensions Atlanta, Ga. Dear Sir: I herewith return the application of Mr. Banks for pension. He is an object of charity as several public collections have been taken up here for him. I have had Dr. B.L. Bridges also to state that he is physically unable to do any labor. I know of my own knowledge that Mr. W.A. Banks has been confined to his bed for three weeks and has been confined to his bed the most of this year. If you ever had a deserving application for a pension, this is one. Every citizen in Ellaville will sign an application to have him placed on the list as it would be a God send to him & help him from becoming entirely dependant upon charity. Very truly yours, Phil E. Taylor, Ordinary WIDOW'S AFFADAVIT State of Georgia Schley County Personally before me comes Mrs. C.H. Banks of said county, who, after being duly sworn, says that she is the widow of W.A. Banks, to whom, in the county of Schley, State of Georgia, she was married on the 2nd day of September 1873, and that she remained his wife, and resided with him to the date of his death in December 1919 and that she has not since his death remarried. At the time of his death he was a resident of Schley county, in said state of Georgia, and he was on the indigent pension roll of the state and paid a pension of $90.00 in Schley county for 1919 per annum, on account of being a soldier in company F, Regiment 5th Ga Volunteers. That she is a bonafide resident citizen of said County of Schley and she has so continuously resided since 23rd day of December 1899. Mrs. C.H.Banks Sworn to and subscribed before me this the 4th day of May 1921. C.R. Tondee, Ordinary of Schley County. (Note: A later affidavit states the marriage took place in Taliferro county. I believe this to be accurate as I have been unable to locate any marriage record for this couple in Schley County.) ORDNINARY'S CERTIFICATE State of Georgia Schley County I, C.R. Tondee, Ordinary of said county, do certify that I know Mrs. C.H. Banks, the applicant for this pension, and that she is the person she represents herself to be, and that she is a bona fide continuing resident of said county and was on the 9th day of December 1919. That I also know Miss Maud Hilsman, witness as to marriage, and I also know (left blank) ; that both of the foregoing were duly sworn by be before signing the respective affidavits, and that they are truthful and trustworthy and their statements are entitled to full faith and credit. Sworn under my hand and official seal of office this 4th day of May 1921. C.R. Tondee, Ordinary, Schley County. APPLICATION FOR PENSION DUE TO A DECEASED PENSIONER (To Be Paid to the Ordinary fro Expenses of Funeral and Last Illness) (Under Act Approved August 15, 1904) Georgia, Schley County. Personally before me, the Ordinary of said County, cones Miss Maud Hilsman, of said county, who, after being sworn, on oath says that he(she) knew Mrs. C.H. Banks of said county, and that said Pensioner was on the Pension Roll of said county at the time of death, which occurred in Schley County, in this state, on the 14th day of August 1928, and that said pensioner left no widow surviving, and no estate of any value suficient to pay these funeral expenses, which amounted to the sum of $100.00, per sworn statements fully and completely itemized hereto attached. Maud Hilsman Sworn to and subscribed before me, W.C. Stewart, Ordinary, Schley County. (Add'l notes: There is a statement typed on Bank of Ellaville stationary, dated Sept. 10, 1928 to H.F. Dixon for West Hixon, re the estate of Mrs. C.H. Banks. It is a bill for $15.00 for digging, walling and finishing grave for Mrs. Banks. It is signed by H.F. Dixon as cashier of the bank and notarized by Jas.H. Hart, N.P. Additionally there is a handwritten bill for expenses incurred as a result of Mrs. Banks care by Miss Maud Hilsman during her last illness for $16.00.)
