Cheney of Schley County, State of Georgia, who, being duly sworn, says on oath that he is a bona fide citizen and resident of Georgia, and has been continuously since the 14th day of August, 1846; that he enlisted in the military service of the Confederate States during the war between the states, and served as a private in Company B, of 17th Regiment of Georgia Volunteers, Toombs & then Bennings Brigade; that whilst engaged in such military service, at the battle of Chickamauga, in the state of Tenn., on the 20th day of Sept, 1863, he was disabled as follows: Was wounded through the left thigh with grape shot or some other large ball, between the hip & knee joint. Ball entered the front of thigh between the femoral artey and bone, ranged up the bone & came out in the middle of the back part of the thigh, five inches higher up than the entrance in front. Considrable sloughing of the muscles of the thigh & sciatic nerve caused the muscles and nerve to contract in healingso that I can not stand on my right & get left heel to te ground; having to use the ball of my left foot in walking. The articulation of the bones in the left knee joint, not being natural or like the right knee causes stiffness of the knee joint & the knee joint to pitch forward which renderswalking unatural and painful. The elasticity (?) of the leg being destroyed by the wounded nerve and contractedmuscle prevents the backward spring of the leg. Deponent swears that he has not been able to walk half a mile since receiving the wound, without considerable pain and suffering. Deponent further swears that said wound has rendered said leg practically and essentially useless. Deponent desires to participate in the benefits of the Act approved October 24th, 1887, and the Acts amendatory thereof, and makes application for the allowance to which he is entitled for the year thereunder, ending October 26, 1895. AFFIDAVIT FOR WITNESSES State of Georgia County of Schley Personally appears before me, the undersigned, Ordinary in and for said County, A.J. Wall, G.C. Dyess & Newton Glover, each of whom, being duly sworn according to law, severally say, under oath, that they are personally well acquainted with J.N. Cheney whose application is herewith presented for a pension, and that they served with him in the army, and from our personal knowledge he was injured by the service as follows: Shot through the left thigh, the ball entering in front and passing out behind several inches above where it entered which caused contraction of the muscle and stiffness of the knee joint. The wound has disabled applicant from all manual labor that requires walking. Applicant does no manual labor of any kind and limps in walking caused from said wound. Deponents were with the applicant when he received said wound and belonged to the same company & have known the applicant ever since the war having lived near him we know that said wound has rendered said left leg practically and essentially useless. The pllicant can not walk any distance without pain & suffering. Applicant has to walk upon the ball of the left foot as the heel of the left leg is drawn up so as applicant can not put left heel upon the ground when standing upright. We personally know above stated facts. We were with him in the army and have known him ever since. Applicant is permanently disabled as stated and has been so to our certain knowledge ever since 18__ . We have no interest in the recovery of a pension by him. A.J. Wall G.C. Taylor, Ordinary of said county, R.T. Bivins and H.S. Munro, both known to me as reputable physicians of said county, who being severally sworn, say on oath that they have carefully examined J.N. Cheney and after such personal examination say the applicant has been injured as follows: Shot through the left thigh with some large ball. Ball passing in front between the femoral artery and femur, ranging upward towards the hip joint lacerating the muscles of the thigh & sciatic nerve, all of which sloughed considerable & in healing contracted the muscles and tendons so that it is impossible for him to stand on each leg alike. The knee joint of left leg is inclined forward & he can not spring the leg backward which position does not allow the leg to resume its proper articulation and renders standing or walking uneasy, unnatural & very painful. The patella reflex of the limb is lost. All of the muscles of the back part of the left thigh are injured & healed tothe scicatrix which destroys ???? natural relations with each other & in walking all being attached by the healing of the wound causes the muscles to be used as one, the scar in front being as large as an egg & in rear larger than a hand, both scars being drawn inward, show the complete attachment of the muscles of the left thigh. The applicant's leg is permanently, practically and essentially useless. We have treated applicant professionally for _______ years. R.T. Bivins, MD H.S. QUESTIONS FOR APPLICANT TO ANSWER: State of Georgia, Schley County Personally appears before me, Mrs. Fannie Foster Cheney, of said State and County and hereby applies for the pension allowed by the Act of 1910, as amended by the Act of 1919and the Constitutional Amendments of 1920 and 1937, and submits testimony to support the same, and, after being duly sworn, true answers to make to the questions propounded, answers as follows, to wit: SECTION I 1. What is your name and where do you reside? Mrs. Fannie Foster Cheney, Ellavile, Schley Co. 2. How long and since when have you been, continuously, a bona fide resident citizen of the State of Georgia? All my life 3. When, where and to whom were you married? March 11th, 1890, Atlanta, Ga., J.N. Cheney a. Have you married since the death of first and soldier husband? No b. When and where did your first husband die? Atlanta, June 1902 c. Were you residing together when he died? Yes d. If not, how long had you resided apart? e. Are you now a widow? Yes f. Have you or your husband heretofore been paid a pension by the State? AN AFFIDAVIT (Read carefully before making this affidavit) State of Georgia County of Schley Before me, the Ordinary of said County, comes Mrs. Fannie Foster Cheney, who, after being duly sworn, deposes and says: 1. That she is an applicant for the Georgia pension allowed to widows of Confederate soldiers; 2. That her deceased husband was a pensioner of the State of Georgia at the time of his death, and therefore, his Confederate military service has heretofore been proven in connection with an application for pension; 3. That she is unable to obtain from any person or source, evidence as to the Confederate military service of her deceased soldier husband; 4. That this affidavit is being made to authorize the use, as evidence, of any official record of said Confederate military service as may be preserved either at the Capitol in Atlanta, or in the office of the Adjutant-General, Washington, D.C. Rainey of said state and county is hereby presented as a witness in support of the application of Mrs. Fannie Foster Cheney for the pension provided by the Act of 1910, as amended by the Act of 1919 and the Consttutional Amendments of 1920 and 1937, in said State, who, after being sworn true answers to make to the questions propounded, answers as follows, to wit: 1. What is your name and where do you reside? J.C.Rainey, Ellaville, Schley County, Georgia 2. How long and since when have you known Mrs. Fannie Foster Cheney, applicant ? Ever since she came to Ellaville to live, 1890 3. Where does she now reside, and since when has she been, continuously, a bona fide, resident citizen of this state? Ellaville, Ga., all her life 4. When and to whom was she married? Dr. J.N. Cheney How do you know? I lived in Ellaville myself 5. How long and since when did you know Dr. J.N. Cheney. her husband? All my life, he was the doctor in attendance on my mother ???? (could be at her death), Dec. 22, ????? 6. When and where did Dr. J.N. Cheney, the husband of the applicant, die? in Atlanta, Ga.--1902, buried in Ellaville. 7. Were the applicant and her husband living together as husband and wife at the date of his death? Ceremony performed by John W. Heidt, Minister. (Notes: from pension cover: John N. Cheney enlisted as a private in Co. B, 17th Regt. Ga. Inf. Aug. 14, 1861. Wounded and permanently disabled, Chickamauga, Ga., Sept. 20, 1863. Roll for Feb. 28, 1865, last on file, shows him on wounded furlough. Signed Lillian Henderson, Director-pensions. Re: Mrs Cheney, Removed from pension rolls, Schley County, Apr. 22, 1946. Mrs. Cheney wants to enter Confederate Home. L. Henderson, Director-pensions) (Add'l information: Dr. John N. Cheney was born Aug. 14, 1845 and died June 26, 1902. He is buried in Ellaville cemetery with first wife, Annie Stewart Cheney and second wife, Fannie Foster Cheney, the subject of this pension filing. Dr. Cheney ran away from home at age 15 and joined the Confederate Army. When his age was discovered, they tried to send him home but he refused and was later wounded at Chickamauga. He was the inventer of the process for manufacturing coil bedsprings. He went to Texas to perfect and sell them and while there decided to study medicine. Two years later he graduated from the Univ. of Pennsylvania and began practice in Ellaville. He was mayor of Ellaville in 1887. His first marriage was to Annie Eliza Stewart on 3 Dec 1867, she died 17 Sep 1888. He married Frances "Fannie"Foster on March 11, 1890 in Atlanta. Death records indicate Fannie Foster Cheney died 27 Mar 1948 in Sumter Co. claiming her residence as Schley Co., death certificate # 6656, age 86 years.)
