Bivins of the county of Schley, state of Georgia, who, being duly sworn, deposes and says that he was on the 20th day of September, 1879, a bona fide resident of this state; that he enlisted in the military service of the Confederate States, or of this State, as a private in company B, 46th Regiment of Georgia Volunteers, that while engaged in such service, to wit : at the battle or engagement of while on duty guarding Federal prisoners in the city of Charleston, sate of South Carolina, while leaning against the wall of the jail, with his back to the wall, leaning on the left foot,the heel of the right foot resting against the wall, his musket leaning beside him on the left side and his arm leaning on the muzzle of the gun at 6 o'clock in the morning--at the approach of the relief, suddenly taking his heel down from the wallfor the purpose of putting himself in proper position, his heel struck the hammer of the musket & discharged it, wounding his left arm between the ??? & the shoulder. in the state of South Carolina on the 9th day of February 1863, he was wounded in the left arm, and that same was amputated below the elbow, that he has not received the payment allowed him for such a limb under the Act entitled an Act to carry into effect the last clause of Paragraph 1, Section 1, Article 7 of the Constitution of 1877, approved September 20th, 1879; that he has not supplied himself with an artificial arm; or that, not having done so, he prefers to supply himself with an artificial arm.
