McLendon, who being sworn according to law, says under oath that she is the widow of Jessie McLendon, who was a soldier in the service of the Confederate States, and served as a member of Compnay ___ , of the 5th Regiment of Georgia Militia; that he enlisted in said service on or about the 15th day of May 1864, and was in the Georgia Militia Army up to 15th Nov. 1864. Died as follows: That while engaged in the Battle of Griswald-ville near Macon, Ga., was shot dead on said battlefield. Deponent further swears that she was the wife of said deceased soldier during his term of service in the Army, and that she has never married sine his death; that she became his wife on the 28th day of January, 1838, and that she has resided in Georgia continuously since the 27th day of June 1817; that Georgia is her home, and was such on the 23rd day of December, 1890, and since said date she has not lived in any other State or locality. Deponent, as widow of said deceased soldier husband, applies for the pension provided by Act of the General Assembly of Georgia, approved December 23d, 1890, for the pension year ending February 15th, 1892, and herewith tenders the proof of her right to receive the allowance granted by said Act. AFFIDAVIT FOR THREE WITNESSES State of Georgia County of Schley In person came before me, the undersigned Ordinary, in and for said County, witnesses Robert Burton and Wm. G. Womack (each known to said attesting officer as truthful, reliable and reputable citizens), who severally say under oath, that, from their own persoanl knowledge, Mrs. Nancy C. McLendon, who was a soldier in Company K of the 11th Regiment of Georgia Militia. That said soldier enlisted in the service of the Confederate States on or about the 15th day of may 1864. That while in said service, or by reason of said service in the Army, he lost his life as follows: That while engaged in the Battle of Griswaldville, near Macon, Ga., he was shot deadon said battlefield, on the 15th of November 1864. Our opportunity for knowing the facts stated in reference to death of applicant's husband were that we were members of the same company & participated in the same battle in which he was killed. We further swear that Mrs. Nancy C. McLendon was the wife of said soldier during the service, and that she has not intermarried since his death, and that she resides in Schley Conty of the State of Georgia. Robert Burton Wm. G. Womack Sworn to and subscribed before me, this the 9th day of May 1891. T.B. Myers (Note: This is of some interest to me, if factual. Robert Burton was Captain of Co. G, 5th Ga. He resigned that position in 1861 as a result of what was thought to be dissatisfaction with him by the men of that company. I was unaware that he participated in any action in the war after that date. This would seem to say that he joined the Georgia Militia.) Wilson (each know to said attesting officer as truthful, reliable and reputable citizens), who severally say under oath, that, from their own personal knowledge, Mrs. Nancy C. McLendon, of the county of Schley, State of Georgia, is the widow of Jessie McLendon, who was a soldier in Company K of the 11th regiment of Ga. Militia. That said soldier enlisted in the service of the Confederate States on or about the ______ day of 1864. That while in said service, or by reason of said service in the Army, he lost his lifeas follows: The said Jesse McLendon was killed at the battle of Griswaldville and the said R.R. Stewart from the knows the fact as the said Jesse McLendon was his neighbor (?), that they were in the same company & Regt., that they entered the militia (?) in the same company and that he help(ed) dig the grave, that he took trinkets and effects from his body and carried them & delivered them to his wife, that he ???? home with the assistance of others of the commi??? the shot that killed him on the day of the ???? was through the heart. Our opportunity for knowing the facts stated in reference to death of applicant' husband were: Wm. A. Wilson was Capt. of the Company of which said McLendon was a member & knows of his service &saw him fall in the battle of Griswaldville. We further swear that Mrs. Nancy C. McLendon was the wife of said soldier during the service, and that she has not intermarried since his death, and that she resides in Schley County of the State of Georgia. R.R. Stewart Wm. A. McLendon, Nancy C. 1836 1904 Additional Comments: There is a R. Burton who served with the 11th Regiment of the Georgia Militia with the rank of adjutant. Perhaps this is the same Robt.
