Owens of said State an County, desiring to avail himself of the Pension Act, hereby submits his proofs, and after being duly sworn true answers to make to the following questions, deposes and answers as follows: 1. What is your name and where do you reside? John J. Owens. Ellaville, Schley County, Georgia. 2. How long and since when have you been a resident of this state? Since 1833. All my life. 3. When and where were you born? Warren Co., Ga., 1833. 4. When and where and in what company and regiment did you enlist or serve? In 1861. In Schley Co. in Co. B, 17th Regiment. 5. How long did you remain in such compamy and regiment? From 1861 (August) until about April 13th 1865. 6. When and where was your company and regiment surrendered and discharged? At Appomattox Court House, Virginia. The 17th Reg. at this time was under Gen. Benning of Columbus, Ga. 7. Were you present with your company and regiment when it surrendered? Yes, I was with it. 8. n/a 9. How much can you earn per annum by your own exertions or labor? Nothing. 10. What has been your occupation since 1865? Farming only. 11. Upon which of the following grounds do you base your application for pension, viz: first, "age and poverty," second, "infirmity and poverty," or third, "blindness and poverty"? Infimity and poverty. 12. If upon the first ground, state how long you have been in such condition that you could not earn your support? If upon the second, give a full and complete history of the infirmity and its extent? If upon the third, state whether you are totally blind and when you lost your sight? I am old and feeble and ruptured so I have to wear a truss. I have no education so as to make a living at any thing except farming & I am not able to to farm. 13. What property, real and personal, or income, do you possess, and its gross value? Between 500 & $600. I have no income. 14. What property, real or personal, or income, do you possess in 1894, 1895, 1896, 1897, 1898, 1899, 1900 and 1902, and what disposition, if any, by sale or gift, have you made of same? 175 acres of as poor land as you will find outside of a desert. i give it for taxes at $350.00 & the grand jury of this county appraised it. 15. In what county did you reside during those years, and what property did you then return for taxation? In Schley Co., Ga. & the same realty & balance in persona???? 16. How were you supported during the years 1899, 1900, 1901 and 1902? On my farm, but I am unable to improve the property even to rebuilding the house which is badly needed. 17. How much did your support cost for each of those years, and what portion did you contribute thereto by your own labor or income? I lived with my family. I should say $120.00 for year. 18. What was your employment during 1898, 1899, 1901 and 1902? What pay did you receive in each year? I lived with my family, could not work & ????? ???? proceeds to live upon. 19. Have you a family? If so, who composes such family? Give their means of support? Have they a homestead, or other property? Their ages and how employed? Wife, 55 yrs., boy 21, girl 19, girl 17, boy 14, John 12, David 11, Liddia(?) 9, Jewel 6. They live on farm with me. They own no property whatever. 20. Are you receiving and pension? If so, what amount and for what disability? No. 21. Have you ever made an application for pension before? Yes. 22. How many applications have you ever made and under what class? Taylor, Ordinary of Schley County. QUESTIONS FOR WITNESS State of Georgia Schley County James M. Owens of said state and Marion County, having been presented as a witness in support of the application of John J. Owens for pension under section 1254, Code, and after being duly sworn true answers to make to the following questions, deposes and answers as follows: 1. What is your name and where do you reside? James M. Owens. Marion Co., Ga. 2. Are you acquainted with John J. Owens, the applicant; if so, how long have you known him? 50 years. 3. Where does he reside, and how long and since when has he been a resident of this state? In Schley Co., Ga. Since I knew him for 50 years. 4. When, where and in what company and regiment did he enlist and how do you know? Co. "B" 17 Ga. Regiment. I was present when he enlisted. 5. Were you a member of the same company and regiment? I was at close of war. 6. How long did he perform regular military duty? from 1861 to 1865. 7. When and where was his command surrendered? At Appomattox Court House, Va. 8. Were you present when it surrendered? I was with him, Yes. 9. Was applicant present? Yes. 10. n/a 11. What property, effects or income has the applicant? (Give your means of knowledge) I am his brother and live near him. 175 acres of very poor land & two poor mules (?) & household goods. 12. What property, effects or income did the applicant possess in 1896, 1897, 1898, 1900, 1901 and 1902, and what disposition, if any, did he make of same? Same as above. He has not sold off anything. 13. Has he conveyed away ant of his property in the last four years, if so what was it, and to whom? No. 14. What is the applicant's occupation and physical condition? He is a farmer. His health is very poor. He is ruptured & not able to work owing to feebleness & old age. 15. Is the applicant unable unable to support himself by labor of any sort, if so, why? He is unable to support himself. He is ruptured & very feeble, & old, being 70 years old, will be 71 on the 12th of Dec. 1903. 16. How was he supported during the years 1898, 1899 1900, 1901 and 1902? Lived on his little farm. 17. What portion of his support for these four years was derived from his own labor or income? None to amount to anything. 18. Give a full and complete statement of the applicant's physical condition that entitles him to a pension under Section 1254, Code? See answer to 14. 19. Who composes family? What property have they? Children's age and their earning capacity? Wife & 8 children, four girls & four boys. One of them 21 years old. They have no property of any kind. 20. AFFIDADIT OF PHYSICIANS State of Georgia Schley County Personally came before me Dr. B.L. Bridges and Dr. R.T. Bivins, both known to me as reputable physicians of said county, who, being severally sworn, say that they have examined carefully John J. Owens, applicant for pension under Section 1254, Code, and after such personal examination say that his precise physical condition is as follows: Mr. John J. Owens has rheumatism, also has been ruptured on right side & he has to wear a truss & from old age & physical weakness, he is unable to do manual labor. and that we have no interest in said pension being allowed. B.L. Bridges, MD R.T. Bivins, MD Sworn to and subscribed before me, this the 10th day of Nov. 1903. P.E. Taylor, Ordinary. ORDINARY'S CERTIFICATE State of Georgia Schley County I, P.E. Taylor, Ordinary, in and for said county, hereby cerify that the applicant John J. Owens resides in said county, and has been a bona fide resident of this state since the ______ day of ________ 1833. and that the witnesses, viz: James M. Owens, Dr. B.L. Bridges and Dr. R.T. Bivins are of trustworthy character, and that their statements are entitled to full faith and credit. I futher certify that before answering the foregoing questions, the applicant and each witness took the oath hereon prescribed, and that the full text of the affidavits was read to the applicant and witness before same was signed. I further certify that the tax digest of Schley County show that applicant returned for taxation in his name in 1899, seven hundred & fifty dollars of property, and in 1900, seven hundred & fifty dollars of property, in 1901 six hundred & ninety-two dollars of property, in 1902 six hundred dollars of property. In my opinion the foregoing claim is by him made in good faith. Witness my hand and seal of office, this 10th day of Nov. 1903. P.E. Taylor, Ordinary of Schley County. (Note: This application was disapproved. There is a note in the file that indicates that the real estate value was such that he was not deemed indigent. He reapplied in 1910 when the regulations were libralized and was granted a pension for 1911. A.J.
