Smith, who was a soldier in the service of the Confederate States, and served as a member of Company B, of the 17th Regiment of Georgia Volunteers; that he enlisted in said service on or about the 14th day of August 1861, and was in the Confederate Army up to April 9th 1865. That while in the Army, he was on the 28th day of August 1862, That at the second battle of Manassas, state of Virginia, he was shot through the right lung with minnie ball and never returned to service in company & regiment any more, but was put on detail service to the close of the war. At the close of the war, he came home and lingered with said wound ??ing through which he was shot, at times spitting up blood until the 9th day of January 1889 when he died from said lung effected by the passage through of said minnie ball. Deponent further swears that she was the wife of said deceased soldier during his term of dervice in the army, and that she has never married since his death; that she became his wife on the 4th day of July 1844, and that she has resided in Georgia continuously since the 5th day of June 1826; that Georgia is her home, and was such on the 23rd day of December, 1890, and since said date she has not lived in any other state or locality. Deponent, as the widow of said deceased soldier husband, applies for the pension provided by Act of the General Assembly of Georgia, approved December 23d, 1890, for the pension year ending February 15th, 1894, and herewith tenders the proof of her right to receive the allowance granted by said Act. AFFIDAVIT FOR THREE WITNESSES State of Georgia County of Schley In person came before me, the undersigned Ordinary in and for said county, witnesses Newton Glover, H.H. Holloway and G.C. Dyess (each known to said Attesting Officer as truthful, reliable and reputable citizens), who severally say under oath, that, FROM THEIR OWN PERSONAL KNOWLEDGE, Mrs. Averrella Smith, of the county of Schley, state of Georgia, is the widow of A.W. Smith, who was a soldier in Coompany B of the 17th Regiment of Georgia Volunteers. That said soldier enlisted in the service of the Confederate States on or about the 14th day of August 1861. That while in said service or by reason of said service in the Army, he lost his life as follows: That at the second battle of Manassas of Virginia, he was shot through the right lung with minnie ball & never returned to said army afterward & lingered until his death and I am satisfied the wound recd from said ball was the direct cause of his death. Our opportunity for knowing the facts stated in reference to death of applicant's husband were: That we were with him in the army and lived near him until his death & being a near neighbor. We further swear that Mrs. Averrella Smith was the wife of said soldier during the service, and that she has not intermarried since his death, and that she resides in Schley County of the state of Georgia. (Note: There is this notation on the outside jacket of the pension application form: "Ex. Dept. 25 Nov 1895. Witnesses are requested to set out more in detail the reasons why they say death resulted from the wound giving the facts on which their opinions are based. Rich Johnson." This notation is followed by several small handwritten pages which would seem to be an attempt to satisfy this request). That at no time since said wound has he been able to do sufficient work for a support, but was constantly affected with severe cough, frequently spitting up blood and at anytime he was compelled to use his right arm in labor, the spitting of blood was increased (being a very poor man, he was obliged to do some work) frequently requiring the attention of a physician. On pratially recovering from the gunshot he was able to get about, but not so as to be able to serve as a soldier. Never (?) was he even (or ever) afterwards able to do heavy manual labor, but has continually, year by year grown worse and more feeble, continually complaining of a pain through the wounded lung, frequently saying "the old wound will kill me some day." He was a stout, hale and hearty man up to the day of the battle in which he received the wound. From our knowledge of him, which has been continuous up to the day of his death, we wound say the cause of his death was directly the affect of said gunshot wound. H.H. Holloway Newton Glover G.C. HANDWRITTEN ON SCHLEY COUNTY COURT OF ORDINARY STATIONARY Georgia Schley County Before (me) in person came C.J.(G) Jones, who upon oath says that he is a practicing physician and that he knew A.W. Smith during his life time and attended him at his residence Macon County (near the line of Schley County) as physician at various times as well as in his last illness, that the said A.W. Smith was wounded in the right lung while in the Confederate service (&) from the effects of this wound, he died.
