All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Harris Hill http://www.genrecords.net/emailregistry/vols/00011.html#0002514 March 1, 2004, 7:57 am FOR USE OF APPLICANTS WHO HAVE NOT HERETOFORE DRAWN State of Georgia Schley County Personally appears Peter Stewart of Schley County, State of Georgia, who, being duly sworn, says on oath that he is a bona fide citizen and resident of Georgia, and has been continuously since the _______ day of his birth; that he enlisted in the military service of the Confederate States during the war between the states, and served as a private in Company A, of 27th regiment of Georgia Volunteers, Colquits Brigade; that whilst engaged in such military service, at the battle of Chancellorville in the state of Virginia, on the second day of May 1863, he was disabled as follows: Had sunstroke while on a forced march during the late war the day Stonewall Jackson was killed from which he partially recovered, leaving him with ????? lorguyeal (?) paralysis and slight mental inability. Physical exercise causes great sense of weariness with prostration which increases annually. He now has pain and oppressed breathing on the slightest effort to perform manual labor with tremblous limbs and cold moist skin and gasping respiration. Said march being made during the battle of Chancellorsville, State of Virginia. Deponent desires to participate in the benefits of the Act approved October 24th, 1887, and the Acts amendatory thereof, and makes application for the allowance to which he is entitled for the year thereunder, ending October 26th, 1894. AFFIDAVIT FOR WITNESSES State of Georgia County of Schley Personally appears before me, the undersigned, Ordinary in and for said County, A.J. McElmurray, Eli Stewart and R.D. Flurry, each of whom, being duly sworn according to law, severally say, under oath, that they are personally well acquainted with Peter Stewart, whose application is herewith presented for a pension and they served with him in the army, and from our personal knowledge he was injured by the service as follows: Had sun stroke while making a forced march at the battle of Chancellorsville in the state of Virginia on the 2nd day of May 1863 which necessitated great exertion in reviving him, and every since then has been greatly debilitated and ?????. Unable to do any kind of bodily labor, which always gives him much weariness, rendering the carring (carrying) on a conversation difficult and tiresome. Was a hearty and healthy man before he was stricken. He is and has been every since then, very weakly, and grows worse each succeeding year until now he is unable to do any kind of manual labor. He was a healthy hearty man for the five years previous to the sunstroke. Was not discharged from the army, but did not do active duty. Was in the army till the close of the war. The disability has been continuous up to now. We personally know above stated facts. We were with him in the army and have known him ever since. Applicant is permanently disabled as stated and has been so to our certaaain knowledge ever since 1863. We have no interest in the recovery of a pension by him. A.J. McElmurray Eli Stewart R.D. PHYSICIAN'S AFFIDAVIT State of Georgia _______ County Personally comes before me ___________, Ordinary of said County, S.A. Murray and M (or W) R. Edwards, both known to me as reputable physicians of said county, being severally sworn, say on oath that they have carefully examined Peter Stewart and after such personal examination say that the applicant has been injured as follows: Had sunstroke while on a force march during the late war the day Stonewall Jackson was killed, from which he partially recovered leaving him with Glasso laryngeal (?) paralysis and slight mental imbecility. Physical exertion causes great sense of weriness with prostration which increases annually. He now has pain and oppressed breathing on the slightest effort to perform manual laborwith tremblous limbs and cold moist skin an gasping respiration, all of which we believe is traceable to the overheat as above stated. State of Georgia Executive Office, Atlanta 4 June 1895 Peter Stewart Dear Sir: I return your pension application because the witnesses say that your condition for the five years following the injury was healthy. It appearing to me that if you were sound and healthy for that length of time that it cannot be the cause of your ???? trouble. Rich. Johnson State of Georgia County of Schley Personally appeared before me the undersigned Eli Stewart, R.D. Flurry and A.J. McElmurray who on oath say that they know the applicant Peter Stewart who made application for pension on the attached blank and have known him continuously wery since the sunstroke described in said application and that for the five years immediately after and continuously up to now, he has been in feeble & poor health gradually grows worse. We were with him in the army and have been his neighbors every since the war. We were well acquainted with him prior to the sunstroke and considered him a healthy, hearty man. Eli Stewart, Lieut. Ellaville, Ga June 10, 1895 Hon. Rich. Johnson, Atlanta, Ga. Dear Sir: The petition of Peter Stewart returnrd for error on back to hand (?). The word healthy on the back of same is an error made by me and should have been feeble. That is unable to stand exposure. If you will look in the body of the petition, you will see that the condition of the applicant has been feeble every since the sunstroke. The parties who made affidavit to the state of his condition has known him continuously every since the sunstroke, being his companions in the army and his neighbors every since. It was my oversight as I told them the question referred to the five years before he was stricken instead of afterwards. I change the word so as to make it speak the same as the affidavit in the body of the petition. If it were not that it is to make both parts correspond, I would not make the change, but would make out new petition. Respty A.J. Walters P.S. The applicant, Mr. Stewart, has grown very feeble and hving but little property to live on, it would be a great hardship for him to fail to get this pension. He informed me that he has been advised for a long time that he was entitled to a pension, but that up to the winter of 1894, 1/2 years ago, he had plenty of property to live on and would not make application. He lost a large law suit 1893, which took almost all of his property, leaving him nearly destitute. Respty A.J. Walters Georgia Schley County Personally appeared before me P.E. Taylor, Ordinary of said county, A.J. Walters who on oath says that he is atty. for Peter Stewart and drew up the petition for a pension ???? 19th day of Feb. 1895, and that the word healthy written after the last question on back of said petition, was a mistake of his and that he in writing it, thought it was for the 5 years previous to and not subsequent to the sunstroke and so explained it to the parties making affidavit.
