Joe Hearn and J.S. Hill were coming to Ellaville. they met Frank Treadway, a negro from Marion county on a narrow place in the road where it was impossible for two vehicles to pass without each giving a part of the road. This the negro absolutely refused to do regardless of Mr. Hill's request. Hill attempted to lead the negro's team to one side so that he could pass. At this the negro became indignant and attacked Mr. Hill with a fence rail. This brought on a general melee in which the negro was stabbed by Hill. The young men then came on to town. In the meanwhile several negroes had congregated in the public road near Mr. D.W. Rainey's to await their return. Mr. Rainey notified Messrs. Hill and Hearn, who as soon as they realized the situation, and not wishing to have further trouble, returned to Ellaville and swore out warrants against Frank and Aaron Treadway. Sheriff Allen and Marshal Hudson went at once to the scene of the trouble, and succeeded in arresting Frank Treadway about 9 o'clock that night and placed him in jail. Aaron was brought to town next day and both carried before Judge Walters, who set Monday morning at 10 o'clock for the investigation. The negroes then swore out warrants for Hill and Hearn, for an assault and battery, which made Judge Walters' court quite lively for a while. Col. C.R. McCrory appeared for Hill and Hearn, and Col. J.R. Williams for the negroes. After investigating the matter Judge Walters bound Frank Treadway over to Superior court for an assault with intent to murder, to await the action of the next grand jury, and dismissed cases against Hill, Hearn and Aaron Treadway. Additional Comments: J.S. Hill would be Josiah S. Hill s/o Archibald Hill and Catherine Barfield Watson. He would have 26 years old at this time.
