Schley Superior Court

It appearing to the court that John R. Respess has been subpoenaed as a 
witness for the defendant in the above stated case & that he fails or refuses 
to attend the court & testify in obedience to said subpeonea, it is therefore 
ordered that the said John R. Respess be served personally with a copy of this 
order & that he appear in court on the first day of the next term thereof & 
show cause if any he has why he should not be punished for a contempt in 
failing to appear & testify in accordance with the requirements of the said 
subpeonea and it is further ordered that this will be entered on the minutes 
of the court.

(Transcriber's note:  There are other mentions of Marcus L. Battle and Susan 
R. Battle in the minutes of the Philippi Primitive Baptist church minutes that 
reflect on this divorce case.  They can be read in the January and February 
1867 minutes should anyone wish to read them.  Marriage records indicate that 
Marcus L. Battle married Susan B. (or R.) Little in Schley County, 26 Jan 
1865.  John R. Respess was moderator and elder at Philippi at this time.)
