Georgia, Marion County

Before me the undersigned, a Justice of the Peace in and for the 804th dist GM 
of said county, in person came E.M. Butt, attorney at law for W.J. Lignor & 
Co. who being sworn deposeth and saith that B.F. Kilcrease of the county of 
Schley said state is indebted to W.J. Ligon & H.H. Cosby of the firm of W.J. 
Ligon & Co., the sum of one hundred and fifteen dollars principal and the 
further sum of six and fifty/100 dollars interest to date besides cash on a 
mortgage note dated April 8th 1880 and due the 15th day of October 1880 in 
favor of W.J. Ligon & Co. against said B.F. Kilcrease on one dark bay horse 
mule, 12 years old named Pete; 1 brindle cow smooth crop off right ear, named 
Bloss; 1 red sided, white back cow marked as above described cow, one pale red 
cow marked as above; 1 two horse wagon; 20 hogs; 1 ox cart; and crop of 1880, 
which said note and mortgage hereto attached is now due and unpaid.  Deponent 
makes his affidavit that execution may issue as directed by law.

Geneva, Ga., April 8, 1880

On the 15 day of October, after date, I promise to pay W.J. Ligon & Co. or 
bearer, at their office in Geneva, Ga., One Hundred & Fifteen Dollars, for 
value received.  For the better securing the payment of the above sum, I do 
hereby sell and convey unto the said W.J. Ligon & Co., their heirs and assigns 
the following described property:  one dark bey horse mule, Twelve years old, 
named Pete, one brindle cow, smooth crop of right ear, named Bloss, one red 
sided, white backed cow, marked as above described, one pale red cow marked as 
above, one two horse wagon, Twenty hogs, one ox cart, my present years crop to 
have and to hold said property to the said W.J. Ligon & Co., their heirs and 
assigns in Fee Simple.  This note to bear interest from date, if not paid at 
maturity at 8 percent per annum, and in case of legal measures to collect this 
note agree to pay all cost and expenses including 10 percent counsel fee.  I 
hereby waive for myself and family all right to the benefit of the Homestead 
and exemption, as provided in Par. 1 of Sec. 1 Article 9, of the Constitution 
of the State of Georgia, now in force, and any exemptions of this or any other 
state or the United States:  To the above property, and all other property I 
own.

Additional Comments:
Kilcrease, Benjamin F: -private May 11, 1861. Transferred to Co. 1, April 19, 
1862 ; to Co. B, 2d Battn. Ga. Sharpshooters July 1862. Captured at Dallas, 
Ga. May 27, 1864. Took oath of allegiance to U. S. Govt. at Rock Island, Ill. 
and enlisted in Co. A, 3d Regiment U. S. Inf. October 13, 1864. Married 
Elizabeth Eubanks, Macon Co. Jan 19, 1854. Found on 1860 Schley census, age 
28. Was a party to a court case in dist, 961 Schley Co. 14 Dec 1885. Found on 
a roster of Confederate soldiers entertained at a reunion at Doles, Worth Co. 
in 1910. He gave his county of residence as Worth (History of Worth Co.) Filed 
for pension in Worth Co. Died after May 20, 1910. Burial: Providence Baptist 
Cemetery, Doles, Worth Co., Ga-WFT post sweetbamalady@ yahoo.com CSA marker, 
no dates, "The Complete Cemetery Records of Worth Co." by Catherine Fussell 
Wells.
