Lucinda Collins Libel for Divorce Filed in Office Sept. 2, 1881 J.N. Cheney, Clerk C(harles) B(ritton) Hudson, plaintiffs atty. STATE OF GEORGIA SCHLEY COUNTY To the Superior Court of said county. The petition of Eli Collins of said county, showeth that on the (torn, several words apparently stating the date of marriage) petitioner and Lucinda Dixon of said county, then a single woman were married in due form of law. Your petitioner and his said wife Lucinda, had lived together, from the time of their marriage aforesaid, until within a few days of the time of their separation as hereinafter mentioned in peace and comfort. And your petitioner showeth that he could not and would not have suspected or believed, until the painful reality broke in upon him that said Lucinda could have been guilty of the infamous crime of adultery. Your petitioner says that he was ever kind and affectionate to his said wife during the time aforesaid and she never had the least cause to complain of your petitioner and your petitioner during all the time aforesaid hoped and believed they would ever have the comfort and encouragement in the (torn) affections of his said wife, but (torn) it is, that said Lucinda forgetful of her obligations and duty to your petitioner on the ____ day of March, 1881, and (unreadable) days before and since that time did commit the offense of adultery. And afterwards to wit on the ____ day of May, 1881, when your petitioner came to the knowledge of the criminal conduct of the said Lucinda, he instantly separated from her wherefore your petitioner prays that citation may issue directing and requiring said Lucinda Collins, wife of your petitioner to be and appear, personally of by attorney at the next Superior Court to be held in and for said county, then and there to show cause, (if any she can) why said marriage entered into as aforesaid, should not be annulled, set aside and made void for the cause aforesaid, and a divorce of vinculo matrimonii, be pronounced between your petitioner and his said wife. And your petitioner avers that he had no property, of which to (torn) schedule, at the time of the separation aforesaid, and that his said wife Lucinda had no separate estate. Lucinda Collins Libel for Divorce in the Superior Court of said county (Torn) The defendant Lucinda Collins is hereby directed and required, personally of by attorney, to be and appear at the Superior Court to be held in and for said county on the 4th Monday in September next, then and there, to make her answer or defensive allegation in response to the plaintiff’s Libel, (torn) default thereof, the court shall proceed according to the stated (torn) which were made & provided. Witness the Hon. C(harles) F. Crisp, Judge of said court, this Sept. (torn) 1881. J(ohn) N(ewton) Cheney, Clerk We the jury find that sufficient proofs have been submitted to our consideration to authorize a total divorce, that is to say, a divorce of vinculo matrimonii upon legal principles upon the parties in this case.
