GREENE VS DELLA GREENE Filed in office Sept. 1st 1889 J.N. Cheney, Clerk Libel for divorce Schley Superior Court, Sept 1888 It appearing to the court by the return of (torn) the Deft in the above stated case, that the (torn) Deft does not reside in said county and (torn) further appearing that she does not reside in this state. It is therefore ordered by the court that service be perfected on the Deft by the publication of this order (torn) ce a month four months before the next term of this court in the Schley County Enterprise, a newspaper published in Schley County, Georgia. Georgia, Schley County I, J.N. Cheney clerk of the Superior Court in and for said county, certify that the above and foregoing petition is a true copy of the original which was filed in my office returnable (?) to the September term of the Superior Court 1888, that the original is lost or misplaced and that the service by publication was had in the case in pursuance of an order of the Honorable Sup Court of said county (torn) onted at the Sept term 1888 the same having been published in the Sumter Republican, the Schley County Enterprise having ceased to be published in Schley Co. at and before the publication could be had in said paper and (torn) Republican assumed the contract of advertising for the County of Schley and that the same was therefore had in the Republican. J.N. Cheney, Clerk Georgia, Schley County To the Superior Court of Schley County The petition of John H. Greene of said county shows that on the 2nd day Feb 188 (torn, but Schley marriage records indicate the year was 1880) he was married to Della Walker who was lately of said county but who now resides out of said state and that your petitioner and said Della (torn) lived together as man and wife until (torn) April 1881 and that on the (torn) have three years before (torn) the said Della Greene for (torn) just cause willfully deser(torn) and has from the (torn) continuously (torn) and resided apart from (torn, several lines missing) from the said Della Greene formerly Walker and that (torn) process may issue requiring the said Della Greene formerly Walker to be and appear at the next Superior Court to be held in and for said County to answer petitioner’s Libel for Divorce. Williams Petitioner’s Atty We the jury find that sufficient proofs have been submitted to (torn) consideration to authorize (torn) total divorce, that is to say (torn) divorce a vinculo matrimonii (torn) upon legal principals between the parties in this case, that is to say a total divorce as to the Pltff John Greene and that all rights & disabilities of the contract of marriage be dissolved as to Pltff John Greene. April 11, 1889 James M. Bray, foreman (Notes: James M. Bray, the foreman of this jury, was a Missionary Baptist minister and would have been about 49 years old at the time of this verdict. He died in March of 1918 and is buried at County Line Baptist church cemetery which sites almost on the Macon County line in northern Schley county. Della Greene is found on the 1880 Schley Co. census in the home of her parents, James & Virginia Walker, in the 882nd G.M. Dist. She is 25 years old. I believe her parents to be James A. Walker and Emeline Virginia Bivins who married in Marion Co., 3 Feb 1853.)
