Marriage Deed - Recorded June 8, 1858 in Schley Co., Georgia

This indenture of three parts made and entered into this twenty-fourth day of 
May Eighteen Hundred & Fifty Eight between Ichabod Davis of the County of Macon 
of the first part; Mary Smith of the County of Schley & said state of the 
second part; and Thomas C. Lamar of the County of Sumter and said state of the 
third part.

Witnesseth that the said Ichabod Davis of the first part for and in 
consideration of the mariage (sic) to be had and solemnized between him, the 
said Ichabod Davis of the first part, and the said Mary Smith of the second 
part, does for himself, his heirs, executors and administrators, covenant, 
grant and agree, that the following described parcel of land situated, lying, 
and being in the thirteenth district of originally Lee now Schley county and, 
known in the plan of said district and county as lots one hundred & fifty five 
& one hundred and fifty four (155 & 154)  and the following described property 
to wit, Negroes Candis, Hannah, Easter, Moses, Red, Charley & Early, which 
shall form and remain to be her separate property & Estate, and shall not in 
law or Equity be subject to the payment of the debts of the said Ichabod Davis, 
or be subject to be sold or conveyed by him, the said Ichabod Davis; but her 
right and title of said property shall be vested in the said Thomas C. Lamar, 
of the third part, for the use and benefit of the said Mary Smith; and the said 
Ichabod Davis further convenants and agrees that said Mary Smith may dispose of 
the said property by will to any person she may appoint , subject, however, to 
the used and enjoyed by said Ichabod Davis, with the approbation and consent of 
the Thomas C. Lamar, during the continuance of the conventure for the mutual 
benefit and advantage of the said Ichabod Davis & Mary Smith, and the said 
Ichabod Davis & Mary Smith nominate and appoint said Thomas C. Lamar, Trustee 
of said property, who is authorized to possess himself of and control said 
property in conformity with this Indenture; and the said Thomas C. Lamar 
consents to said nomination and appointment, of Trustee as aforesaid.

	In witness when of, the parties of the first, second, & third parts 
have hereunto set their hands and affixed their seals this day and year above 
written.

Personally appeared Wm. A. Black, who being sworn that he was present & saw 
Ichabod Davis, Mary Smith & T. C. Lamar sign, seal & deliver the written 
marriage deed and that he signed the same as a witness & saw Elizabeth Walker 
do likewise by making her mark.

This is the 2nd marriage for Mrs. Mary Smith.  She was the widow of Lovett B. 
Smith, who's will was written January 7, 1851 & recorded in Sumter Co., Georgia.

Thomas C. Lamar is Dr. Thomas Cato Lamar, son-in-law of Mrs. Mary Smith.  He 
married Mary Elizabeth Smith, daughter of Lovett B. & Mary (?_____) Smith on 
September 9, 1845 in Schley Co., Georgia.
