PATTY SPARKS COLLINS Georgia, Macon County I, Mrs. Patty Sparks Collins of said State and County of Schley, being of sound and disposing mind and memory, do make, publish and declare this my last Will and Testament, hereby specially revoking and annulling all previous Wills heretofore made by me, one in number. Item 1. I desire that my body be buried in a manner in keeping with my position in life, in the city cemetary in Ellaville next to and beside the grave and burial place of my deceased brother W. P. Sparks. I direct my executor to add corner posts on the four corners of the coping of the cemetary lot. Item 2. I direct that all my just debts be paid as soon as possible after my death out of any funds of my estate most available therefor. Item 3. I bequeath to Haines Collins, my step-son, one hand painted bowl, grape design; one tall silver syrup pitcher on which is engraved fancy designs; also table linen consisting of table clothes and napkins on which is embroidered the letter "C". Item 4. I will and devise to Earl Collins, my step-son, all of the set of Haviland china remaining at the time of my death; also a certain flat silver set on which is engraved the letter "C", same being Rogers silver, not sterling. Item 5. I will and devise to Harry Collins, my step-son, the large picture and the frame around the same, hung over mantle in my bedroom; Also one oak wardrobe with mirrowed doors. Item 6. I will and devise to Louis Collins, my step-son, my cut glass punch bowl and the glass cups in connection there with, not including any ladler. Item 7. I will and devise to Miss Imogene Smith, my cousin of Talbot County, the sum of $100, if she be living at the date of my death but not otherwise. Item 8. I will and devise to Mrs. Kate Smith Battle, my cousin, of Talbot County, Ga., the sum of $100. if she be living at the date of my death, but not otherwise. Item 9. I will and devise to my brother, Walter Sparks the sum of $100 if he be living at the time of my death, but not otherwise. Item 10.I give and bequeath to McCurdy Sparks the sum of $100 and if he should pre-decease me, his children living at the time of my death shall receive his $100 share, and if no children are living at the time of my death and my brother should previously die, then this legacy is to be void entirely. Item 11. I give and bequeath to my neice, Betty Lester Buckner, the daughter of Mrs. Nellie Lester Buckner, one cedar chifferobe, and one cedar chest which were built out of cedar from my grandfather's farm; one gold band plain ring given to me by my father; my piano and music cabinet; one rocking chair which like the cabinet is inlaid with pearls. Said property to be delivered to and become the unconditional property of said Betty Lester Buckner if she be of age at the time of my death, and if she is not of age, I then direct my executor to deliver said personal property or such of it as remains at the time of my death to Mrs. Nell Lester Buckner for the benefit of said minor child and a receipt from said mother for said property, of my executor shall relieve him of any further responsibility under this will on account of said personal property. Further bequests are hereinafter made to said Betty Lester Buckner. Item 12. I hereby will and bequeath to Mrs. Nell Lester Buckner, my niece of Macon County, Georgia, all other property of which I may die seized and possessed of every description, including jewelry, silver, linen, china, and all household and kitchen furniture, except that above specially bequeathed; all bank stock; notes, deeds, real estate and all other property of every description for and during the term of her natural life, and at her death, the same to go to and be the property of said Betty Lester Buckner, my great niece, and any other children which may be born hereafter to the said Nell Lester Buckner. Item 13. I hereby will and bequeath to Betty Lester Buckner and any and all children born to Mrs. Nell Lester Buckner share and share alike, the remainder interest in fee to all property remaining at the termination of the life estate of Mrs. Nell Lester Buckner. Item 14. I hereby direct my executor to turn over to the life tenant, Mrs. Nell Lester Buckner the household and kitchen furniture, silver, china, and all other jewelry as it stands at the time of my death and her receipt for the same shall acquit and protect my executor against any responsibility therefor and I will rely upon the honor and integrity of Mrs. Nell Lester Buckner to hold same as practical as possible and enjoy the same for and during her natural life so that the remainder may be left for her children. Item 15. I hereby nominate Jule Felton of Macon County, Georgia as the sole executor of this my last will and testament, and I direct him to deliver the legacies, in case my estate is solvent, to the legaties herein named; to deliver said special legaties made to Betty Lester Buckner to her mother, Mrs. Nell Lester Buckner the personal property which it is not appropriate to invest or change the character of and such delivery upon proper receipts will relieve and acquit said executor. I direct him to keep intact the land, real estate investments, bank stock, loans, and cash which I may have on hand at the time of my death. I hereby authorize him as executor to make new investments taking the security deeds and other conveyancies in his name as my executor, and to manage the same as I have done, or if living could so for the benefit of the life tenant so far as the income is concerned, and the preservation of the remainder for those entitled to take hereunder. Said executor may pay to said life tenant the interest and profits that arise from my property and money at the time he collects it or at seasonable times of any year. He shall have full power and authority to manage, hold, and conduct my entire ownings and holdings for the benefit of said life tenant as long as she lives, and then deliver the remainder as soon as it is proper to do so under the circumstances existing at the termination of the life estate. I hereby authorize and empower said executor to sign any necessary papers or contracts to effectuate my will; to sell either at public or private sale any property that I may own for the purpose of re-investment or satisfaction or settlement of existing contracts, and to do any other or further thing that may be necessary to carry on my business as I leave it and to conduct the same after my death without procuring any order for anything from any court for any additional authority. It is not my intention to limit investments to those prescribed by law or required by law, but I leave the investment of my money and property to the discretion and integrity of my executor and make his judgement the guide by which it is to be done. In wirness whereof I have hereunto set my hand and seal this January 12, 1937 Mrs. Patty Sparks Collins (signature) Signed, sealed, declared and published by Mrs. Patty Sparks Collins as her last will and testament in the presence of the undersigned witnesses who sign the same as witness thereto at her special instance and request, she having signed the same in our presence and we then having signed as attesting witnesses thereto in her presence and in the presence of each other. (Patty Sparks) Collins who was born March 20, 1880 and died in Ellaville on October 8, 1953. She married Mr. T.A. Collins on June 2, 1909 (T. A.'s second marriage - his first wife died in 1905). The will was executed in Macon County but probated in Schley County where Mrs. Patty Collins lived from 1909 until her death in 1953.
