Hill, of said county, being of sound and disposing mind and memory, do make this my last will and testament, hereby revoking all others that I have heretofore made. ITEM 1 It is my will that (my) body be buried in a decent and Christian like manner, the place and details of which I leave to my wife. ITEM 2 It is my will, desire and I so direct that all my just debts be paid as soon as practicable after my death. ITEM 3 I will, bequeath and devise to my beloved wife Viola Hill, all the money that I may be posessed of after paying all of my just debts, including all insurance money that may be due my estate at my death to be hers absolutely to do with as she may deem best and proper. Also, all stocks and bonds that I may be posessed of at the time of my death. I also give, bequeath and devise to my said wife, Viola Hill, all of my property both real and personal of whatever kind and whereever situated, for her use and benefit for and during her natural life except that part of any property herein specifically bequeathed in this will in items four, five, and six and seven and she has the right to sell, borrow money of dispose of or do anything in reference thereto that she may deem best and proper. Should it become necessary for her comfort, welfare and maintanence in life and without any order of any court and without consent, control or interference with her by any other person or persons, subject only to the oblogations upon her part to pay the taxes, keep the property insured and preserve it in such a way as she may deem best and proper, without any liability to any other person for waste or mismanagement. ITEM 4 I will and bequeath to my son, O.C. Hill all indebtedness that may be due me at the time of my death and direct that said indebtedness be cancelled and not collected. ITEM 5 I will, bequeath and devise to my son M.C. Hill, my farm known as the Maye(?) Pilcher farm located in the 185th militia district and the 30th land district of Schley County, Georgia, consisting of about one hundred and thirty five acres of land, more or less and being the lot of land off of which the Pilcher dower was taken and now owned by said M.C. Hill. ITEM 6 I will, bequeath and devise to my sons O.C. Hill and M.C. Hill, all of my undivided interest in and to the farm known as the Hill and Green farm, consisting of the west half of lot of land No. 223 containing 100 acres of land, more or less and 150 acres, more or less off of lot of land No. 228 being all of said lot lying west of _ugslicia Branch, said land situated lying and being in the 29th land district of Schley County, Georgia. Also 127 acres of land, more or less, off of lot of land No. 227, being the same land as described in deed from W.L. English to R.S. Green, R.E. Hill, M.C. Hill, and O.C. Hill and recorded in the clerks office of Schley Superior court, Schley County, Georgia in deed book P, page 439, to be theirs absolutely and in fee simple. ITEM 7 At the death of my said wife, I will bequeath and devise to my daughter, Marguerite Hill, the house and lot where I now reside, being located on the northside of College street in the city of Ellaville, Schley County, Georgia, and known as my home residence to be hers absolutely and in fee simple. ITEM 8 After the death of my said wife, it is my will and desire and I so direct that all of my property both real and personal, except that part of any property herein specifically bequeathed in this will in items 4, 5, 6 and 7 and not disposed of or used by my said wife under the provisions of item 3 of this will, be equally divided among my three children, O.C. Hill, M.C. Hill and Marguerite Hill, share and share alike. It is my wish and desire that my property be divided in kind if it can possibly be done by said children, but if my said children can not agree on a division in kind, then I direct the same be sold by my executor, herinafter named and appointed, either at public or private sale as he may deem best without any order from any court for this purpose and the proceeds of said sale be equally divided among my said three children, share and share alike after all expenses and commissions have been paid and in the event of any of my said children should die before this will takes effect, leaving a child or children then such child or children to take and have the share going to its parent per capita as between themselves. If more than one child of such deceased parent and should either of my said children die without leaving any children of their own, then and in that event said child's part of any said estate shall revert back to my estate and same be equally divided among my other children, share and share alike. ITEM 9 I hereby name, constitute and appoint my son, O.C. Hill as executor of this will and testament and I hereby expressly relieve him of making any inventory and appraisement of my estate, of from giving any bond or making any return to any court and should it become necessary for the comfort, welfare and maintanence of my said wife and she should decide to sell any of my said property as provided in item three of this will, I hereby expressly confer upon my said executor full power and authority to make good and sufficient conveyance to the purchaser to such property as she may decide to sell & further hereby expressly confer upon my said wife the power and authority to borrow money on(?) for the use of said estate in any instance where she may think it necessary and proper on any of my said property and to secure the same. I hereby expressly authorize my said executor to make and execute any lien, mortgasge, or security deed or trust deed or other form of security to as ___ any part of my estate not hereinafter especially ____sed then my said executor may do without the order of any court. It is intended and I hereby request my said executor to look after the farming interest of my said estate for my wife, the live stock, all feed stuff and plow tools and should it become necessary to sell or trade any of the live stock, I expressly authorize my executor to do so and replace same with other stock equally as good as that sold or traded, and for his services in looking after the farming interest and assisting his mother in the management of my said estate, I hereby allot him the sum of two and one half percent of all net income of any said estate, which is in lieu of the regular fees allowed by law.
