Sears, knowing the certainty of death, and being in my proper mind, do make this as my last will and testament. First arrange for my.......(pg torn and a portion of this line missing).......no right to the disposition of my soul, and simply submit to my creator its future destiny knowing that he doeth all things well. I first give to my wife, Mrs. M.F. Sears, Lots 1, 2, 3 & 4, block "A," in the town of Kissimmee, Fla., Sears addition, with all the buildings and appurtenances thereunto belonging, to have for her own benefit during her natural life and at her death said described lots shall go to my youngest son, W.J. Sears, Jr., in fee, to have and to use as he may deem proper. Should my wife die before W.J. Sears becomes of lawful age then (the) property above described given to my wife shall go to my four oldest sons, W.D. Sears, E.L. Sears, R.J. Sears, and J.W. Sears or their heirs, in equal division, or the event of marriage by my wife, then the property given her as above described shall go to, and for the use of my youngest son, W.J. Sears, Jr., in fee, and for his own use as he may direct. I also give to my wife, Mrs. M.F. Sears, all of my notes and accounts and any money that may be on hand at my death. I also give to my wife one black horse, named Dolly and one top buggy, also one cow, and three show cases in the store room. I also direct that my wife pay all burial expenses from any funds on hand, or from proceeds of accounts (?), I also give to my wife all of the house hold and kitchen furniture. Next, (I) give to my oldest son, Dr. W.D. Sears, who now lives in Georgia, my entire stock of drugs.......(pg torn, and a portion of this line missing)......also my entire lot of medical books, journals, with all of my instruments, operating and rectal, eye, dental (unreadable). I also give my son, Dr. W.D. Sears, ten acres of land, which is SW 1/4 of NW 1/4 of NE 1/4, Sec(tion) 14, T(ownship) 25, R(ange) 29. I next give to my son E.L. Sears, Lot 3 in block "B," Sears addition to the town of Kissimmee, Fla. Also, 13 acres of land, beginning at NE corner of SW 1/4 of NE 1/4, south 10 chains, W(est) 13 chains, N(orth) 10 chains, thence East 13 chains to the place of beginning, lying and being in Sec. 10, T(ownship) 25, S(outh) of R(ange) 29 E(ast). I next give to my son R.J. Sears, East half of lot 2, Block "5," Robinson's addition to the town of Kissimmee, Fla., with the improvements and appurtenances thereto belonging. I also give to my son R.J. Sears, 15 acres of land in Sec. 15, T 25, R 29, beginning at NW corner of SW 1/4 of NW 1/4, East 210 yards, south 330 yards, West 210 yards, North 330 yards. I next give to my son J.W. Sears, west half of lot 5, block "B," Robinson's addition to the town of Kissimmee, Fla., with all the improvements and appurtenances thereunto belonging. I also give to my son J.W. Sears, 5 acres of land in Sec. 15, T 25, R 29, which is S 1/2 of SE 1/4 of NW 1/4. I also give to my son J.W. Sears an open face gold watch now being worn and used by my youngest son, W.J. Sears, Jr. I next give to my youngest son W.J. Sears, Jr., one double case gold watch, also one double barrell shot gun, and any other article belonging to my estate and not specially disposed of in this instrument, I give to my youngest son, W.J. Sears, Jr. I have disposed of my effects as in my judgement and discretion I thought best and proper, having occasionally given to my oldest sons, William, Edward, Robert and John Sears according to my ability and judgement for a number of years in the past. I hereby constitute and appoint my wife Mrs. M.F. Sears as Executrix of this will and testament, to execute the same, and it is my request and desire that she shall serve as said Executrix without being required to give bond for the faithful performance of said duties. I hereby revoke all former wills by me made. In witnes whereof I have hereunto set my hand and seal to this my last will and testament, which is written upon three pages of paper, this 28th day of December, a.d., 1893. William J. Sears (seal) The foregoing last will and testament of William J. Sears was by him signed and sealed in my presence and at the same time (unreadable) by the said William J. Sears as his last will and testament and we have hereunto set our hands as witnesses thereto at the request of the said William J. Sears and have signed our names hereto as witness aforesaid in the presence of the said William J. Sears and in the presence of each other, this 28th Day of December, A.D. 1893. E.D. Sears, having retained my proper mind until the present, and still realizing a strong trust and confidence in God and his goodness, desire to make this as supplementary to my former will. Having already made a dispostion of my property in my former will, there has been some little accumulation since which causes this codicil to be made. I now give to my two sons William D. Sears and Edward L. Sears, my entire stock of drugs, glassware, notions, stationary (?), with all the furniture show cases and fixtures. I also give to my son William D. Sears, all of my instruments, office chair, operating, dental, cautery battery (?), apron, and all of the instruments used in my practice, also my medical books (unreadable) U.S. Dyphencatory (?) which goes with stocks & Co. Now in the event of my death, I direct that the store be closed until the said W.D. & E.L. Sears shall make some disposition or directions as to what they may desire in the premises. The accounts belonging to the store and for my practice with whatever amount of cash there may be on hand after all debts have been paid, including burial expenses shall go to my wife Mary F. Sears, to be used as she may deem proper. I also desire to give my son Edward L.
