I, Hattie C. Tondee, of said State & County being of sound and disposing mind and memory (?) deemed it right and proper both as respects my dear friends and relatives and myself that I should make a disposition of the property with which a kind Providence has blessed me. I do therefore make this my last "Will" and "Testament" hereby making and amending all others by me heretofore made. First I hereby appoint Seaborn Montgomery of said State and County, my Lawful Executor without bond and exempt him from making any inventory of my estate and exempt him from making any returns of any kind of his actings and doings as such executor to any court whatever. The said Seaborn Montgomery, shall have full poer to sell at either public or private sale, and ???? terms as he may deem best or think proper ??? or all of the property whether realty or personalty, of which I may die siezed at either public or private sale and without any order from any court whatever. Second I direct that the ????? omits ???? and profits in charging interest accrued on money loaned and the ????? income arrising from all property herein conveyed and of which I may die siezed, be given to my dear friend and relations Seaborn montgomery and Julia Montgomery, his wife, or the surving one if either of them should die, said income shall be free from any debts or obligations of said grantees, and to be in no way subject thereto but intended for their support, comfort and maintenance, so long as either one of them shall live. My executor is hereby directed to manage all said property in such a mannor as to bring best possible income annually for said Seaborn Montgomery and Julia Montgomery ot to the surviving one of them after one them should die so as to ????? them or either of them a comfortable support so long as either one of them may live. Third After the death of both of my two friends, relatives and benefactors, Seaborn Montgomery and Julia Montgomery, I desire that half of the property remaining in my estate shall be divided among the heirs of Seaborn Montgomery and the other half among the female heirs of myself according to our(?) state laws of inheiritance. In testimony whereof I have jereto set my hand and affixed my seal, this the 23rd day of August ????? Domini Eighteen Hundred and Ninety Three. Hattie Tondee [L.S.] Signed, sealed , delivered and published by Hattie C. Tondee as her last "Will" and "Testament" in the presence of the undersigned, who subscribed our names hereto, in the presence of the Testator at her special instance and request and in the presence of each other. This the 23rd day of August 1893, A.R. Foster J.C. Pope G (or S) J. Carter State of Georgia. To Hon. T(?) M. Allen, Ordinary of said Co., Sumter County. The petition of L.E. Tondee of Schley County, Georgia shows the following facts to wit: First That Miss Hattie C. Tondee, late of Sumter County, Ga. died testate on the 2? day ______ owning real and personal property in said state amounting to some two thousand dollars. Second That the executor therein named is Seaborn Montgomery who has also died since said "will" was written and that that administration to pay debts of deceased is necessary. Third That petitioner is a brother and next of kin to the testator named and is entitled to administer on said estate. Fourth Petitioner herewith presents said "will," probated in comi???? form, and that he may be appointed administrator c????? testamento annexo and that citation giving notice of this application to all concerned for permanent letters of administration be issued and published as required by law and petitioner prays that when this is done that same be granted as the law directs. L.E. Tondee, petioner. Affidavit to "Will" State of Georgia Sumter County Before me personally appeared J.C. Pope named as a witness to the within writting perporting to be the last "will" and testament of Miss Hattie C. Tondee, who being duly sworn deposes and says that he with J.R. Foster and S.J. Carter did on the 23rd day of August 1893 attest as witness the within writing in the presence of Miss Hattie C. Tondee who in teir presence voluntarily signed the same as her ast "will" and "testament" and that the said Hattie C. Tondee was at the time of said attestation and signing of sound mind and disposing memory. J.C. Pope Sworn to and subscribed before me this July 31st 1903. Thos. M. Allen, Ordinary Sumter County, Ga. Miss Hattie Tondee-Will. Petition of L.C. Tondee to have will probated in Cor???? from continued. Addidavit to "Will" State of Georgia Sumter County Before me personally appeared J.C. Pope named as a witness to this with??? writing perporting to be the last "will" and testament of Miss Hattie Tondee, who being duly sworn deposes and says that he with J.R. Foster and S.J. Carter did on the 23rd day of August 1893 attest as witnesses the within writing in the presence of Miss Hattie C. Tondee, who in their presence voluntarily signed same as her last "will," and "testament" and that the said Hayyie C. Tondee was at the time of said attestation and signing of sound mind and disposing memory. J.C. Pope Sworn to and subscribed before me yhis July 31st 1903. Thomas (?) Allen, Ordinary, Sumter County, Ga. Ordinary Ordinary The foregoing petition of L.C. Tondee, praying probate of will of Miss Hattie C. Tondee in Co?????? form and further praying the issuance of Letters of Permanent Administration in said estate Co??. Testament A??????, being supported by the affidavit of J.C. Pope annexed(?) one of the witnesses to said will and thr contents of said petition appearing to be true. It is now ordered that the same be recorded having been duly proven in Co??????? from fully as law directs. It is further directed that citation (?) for personal letters of administration Co?? Tondee, deceased, late of said county, notice is hereby given that said application will be heard at the regular time of the court of Ordinary of Sumter County, Ga. to be held on first Monday in August 1903.
