I Stephen Marlow of the State of Georgia Screven County, being of sound and disposing mind and memory do make ordain & declare this to be my last will and testament hereby revocking (sic) and making void all former wills by me at any time heretofore made. Item 1: It is my will and desire that all my just debts be paid as soon after my decease as possible. Item 2: I give desire and bequeath unto my grandson Isiah Conner one hundred acres of land situated in said County to commence at the west side of a tract or parcel of land containing two hundred and seventy two acres adjoining Hillory Flakes land to be bounded on the south by the middle ground road. North by David J Archer’s land the dividing line to run east and west so as to include one hundred acres. Item 3: I give and bequeath to my grand daughter Mozell Conner to be paid to her at the final distribution of my estate fifty dollars. Item 4: I give and bequeath unto my beloved wife Elenor for and during her natural life all the residue of my estate real and personal, and at her death to be equally divided between my three children in the manner and conditions following: to wit, to my daughter Ann Blitch, widow, I give bequeath and devise the one third of the property bequeathed to my wife during her life for her sole and separate use free from the debts liabilities or enjoyment of her husband should she ever marry ,and after her death to such child or children as she may leave. To my daughter Susanah Hodge wife of Hardy Hodge I give bequeath and devise the one third of the property bequeathed to my wife for her sole and separate use, free from the debts or enjoyment of her present or any future husband for and during her natural life and after her death to such child or children as she may leave. To My son Robert Marlow, I give bequeath and devise the one third of the property bequeathed to my wife. These bequeath to my three children, Ann, Susanah and Robert to take affect at the death of my wife Elenor Marlow. Item 5: I hereby constitute and appoint my wife Elenor Marlow sole executrix of this my last will and testament. In witness where of I, said Stephen Marlow, have to this my last will and testament contained in this sheet of paper set my hand and seal this 30th day of December in the year of our lord one thousand eight hundred and sixty. Stephen Marlow We whose names are hereto subscribed have subscribed the same as witnesses to the last will and testament of Stephen Marlow at his special instance request and in his presence and in the presence of each other. (signed) David J Archer Isiah Conner Elizabeth Blitch Came in open court at this regular term of the court this regular term of the court David J Archer and being duly sworn depose and says that his signature to the within as Witness to the last will and testament of Stephen Marlow is genuine that he believes he signed the same as witness as aforesaid, and he believes he did so in presence is said Stephen Marlow. And said Isiah Conner, Elizabeth Blitch the other witnesses to said will and testament and that said Stephen Marlow signed the said will and testament as he believes in the presence of said witnesses as he believes the said Witnesses signed the same in the presence of the said Stephen Marlow & that he and the other witnesses as he believes signed the same at the request of said Stephen Marlow.
