Ellis of the county of Henry of the one part and David Heflin of the county of Pike of the other part Witnesseth that the said J.T. Ellis for and in consideration of the sum of three hundred dollars to him in hand paid at and before the sealing & delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold aliened conveyed and confirmed & by these presents do grant bargain sell alien convey & confirm unto the said David Heflin his heirs & assigns all that lot of land except thirty acres of land on the north side of said lot containing two hundred two & one half acres known by lot number ninety seven (97) in the third (3) district of the county of Henry and State aforesaid To have & to hold the said lot & tract of land with all & singular the rights members & appurtenances thereof whatsoever to the said lot and tract of land being belonging or in any wise appertaining with the remainder & remainders to the only property use benefit and behoof of him the said David Heflin his heirs executors administrators & assigns in fee simple And the said J. T. Ellis his heirs executors & administrators, the said bargained lot of land unto the said David Heflin his heirs executors administrators against the said J. T. Ellis his heirs executors & administrators and all & every other person or persons shall & will warrant & forever defend by virtue of these presents in witness whereof the said J. T. Ellis of the one part Harry Swinney of the other part both of the county & State aforesaid witnesseth that the said J. T. Ellis hath for & in consideration of the sum of four hundred & twenty eight dollars to him in hand paid hath, this day granted bargained sold & conveyed unto the said Swinney ninety acres of land being the north part of Lot No. 162 (one hundred & sixty two) known as the place where Hillary Brooks formerly lived in the third dist. of the said county & state aforesaid To have and to hold with all & singular the rights and appurtenances thereunto belonging & the said Ellis for his part his heirs & assigns do warrant & forever defend the rights & titles of the above described land unto the said Swinney free from his claim or the claims of any other person whatsoever forever in fee simple In witness whereof I have hereunto set my hand & seal the day & date first above written – Signed sealed and delivered in the presence of Ellis Rogers Jas.
