Pag 22-23 Ga. Archices Drawer 164 Box 63 Written: March 18, 1856 State of Georgia Spalding County In the name of God Amen, I Philip J. Bishop of said State and County feeling life is very uncertain and knowing I shall shortly have to depart this life deem it right and proper both by respect to myself and family that I shall make a disposition of the property with which a kind Providence has Blessed me. I therefore make this my last will and testament hereby Revoking all others heretofore made by me. 1 Item. I desire and direct that my Body be Buried in a decent and Christian like manner just as my family may think best. My soul I trust will return to God who gave it as I hope for External Salvation through the merits and atonement of the Blessed Lord and Saviour Jesus Christ. 2 Item. I desire all of my just debts be paid by Executor hereafter appointed. 3 Item. I give devise and bequeath to my beloved wife Francis with whom I have lived in the strictest quiet for a number of years all of my property both real & personal for and during her natural life time or widowhood. But in case she should marry again I then wish a division of my entire estate given to my wife one third during her natural life time another to be equally devised my children hereafter named. 4 Item. In case my wife should marry again I then wish a devision give to all of my children an equal share within the two thirds of my estate after my wife gets her third as mentioned in 3 Item. 5 Item. I leave it discretionary with my wife to give the balance of my children as they may marry or become of age the amount as I gave to my daughter Mary A. E. when she married taking a receipt for the same that they may be equal in the end. 6 Item. The names of my children are as follows: Willis M., Mary A. E., Martha A. Francis, Jane Letha P, Sarah P. Lavonia, Amerlie S. J., Phroenicia T. Bishop. 7 Item. I appoint my son Willis M. Bishop my lawful executor to this my last will & testament. Signed sealed and delivered and published by Philip J. Bishop as his last will and testament in the presence of us the subscribers who subscribed our names hereto in the presence of said testator at his special instance and request and of each other this 18th March 1856. Philip J. Bishop Test. James Lavender Edward F. Knott John A. Dunn Georgia Spalding County In person appeared before me James H. Mangham, Ordinary in and for said County, James Lavender and Edward F. Knott who being duly sworn depose and say that this paper contains the Last Will and Testament of Philip J. Bishop, Late of said County deceased. The (deceased) was of sound mind and memory at the time of the making of said will and testament and that it is just and true in all its parts. Bishop do solemnly swear that this writing contains the last will and testament of the within named Philip J. Bishop deceased so far as I know or believe and that I will well and truly execute the same by paying for it the debt and then the Legacies contained in said will as far as his Goods & Chattles thereunto extend and the Law charges me and that I will make a true and perfect inventory of all such goods and chattels, so help me God.
