Will Book A P. 18-19 Written: 1856 LAST WILL AND TESTAMENT WILLIAM ELLIS STATE OF GEORGIA ) SPALDING COUNTY } In the name of God Amen I William Ellis of the county and state aforesaid being much advanced in age but of sound mind and knowing that I must shortly depart this life, deem it proper to make a disposition of the earthly conserns with which it hath pleased God to bless me hereby revoaking all other wills heretofore made by me. Item 1st. It is my desigr that my body be interred in a decent and Christian- like manner suitable to my condition in life. Item 2nd. It is my wish that all my just debts be paid if there should be any, soon after my desease. Item 3rd. I give to my beloved wife Martha with whom I have lived fifty-seven years in the most perfect harmony, all my estate both real and personal of whatever kind it may consist for and during her natural life or widowhood. Item 4th. After the death or marage of my wife, I direct that all my estate of every kind be equally devided between all my children and legal representatives of children, with the following exceptions (vis) To Joseph Creal who married my daughter Martha (she being dead) I give five dollars and no more out of my estate. To Reuben Wrigt who married my daughter Sofiah (she being dead) I give five dollars and no more of my estate, the children of my daughter Sofiah are to receive nothing more from my estate. From my son William J. Ellis’ portion is to be divided Eighteen hundred twenty-eight dollars, that is to say my other children, John A. Ellis, R. P. Ellis’ children, James T. Ellis, and Francis Wilson each receive the sum of eighteen hundred and twenty-eight dollars to make them equal with my said son William J. before he shears equally; and my Daughter Lucy Wilkins having received the use of lands upon which she is living is to receive no more untill the said unadvanced children receive the said amount of eighteen hundred and twenty-eight dollars then she is to come in equally. She is however at the devision of the Property to have all that portion of No. sixty-six that I now own being one hundred and ten acres, together with the appurtenances thereunto belong(ing) for her natural life the use of which said land counts as her advancement. She is not to dispose of the same or allow others use when it the said (land) together with all the rest of her portion received from my estate (is) to be in trust – My said Executors to controll the same untill her death and then to be equally (divided) between my other Legatees to wit (John A. Ellis, ) James A.(T.) Ellis, William J. Ellis, and Francis Wilson. And also out of the portion of Francis Wilson is to be taken the valuation of a Negro boy George about eleven years old which said Negro boy George I hereby direct my said Executors to have valued and turn over to my Grandson William M. Wilson in fe simple. Item 5th. For the purpose of executing this my last will and Testament I hereby constitute and appoint my beloved sons John A. Ellis and James T. Ellis my Executors with full power to sell and devide As prudence and interest may dictate at the time.
