Spalding County was created from Fayette County between the time the will was written and probated. Georgia In the name of God Amen. I Benjamin Starr Fayette County of Said County and State being of advanced age and knowing that I must Shortly depart from this world deem it right and proper both as respects myself and my family that I should make a disposion of the property with which a kind providence has has (sic) blessed me I therefore make this my last Will and Testament hereby revoking and annull- ing all others heretofore made by me. Item first I desire and direct that my body be buried in a decent and Christian like manner Suitable to my circumstances and conditions my Soul I trust Shall Return to rest with God who gave it as I hope for Eternal Salvation through the blessed Lord and Savior Jesus Christ whose Religion I have professed and as I humbly Trust enjoyed for forty years. Item Second I desire and direct that all my Just Debts be paid without delay by my Executors hereinafter named. Item third. I give and devise to my beloved wife Charlotte Starr with whom I have lived in the Strictest quiet and love for forty five years all of my Property and real and personal during her natural lifetime. Item fourth. I desire that if my Executors Should think proper to dispose of any of my property they may do So at anytime they think best in a private Sale or any other way they may think proper or best. Item fifth. I desire that all of the money that is owing to me in Notes and accounts that they Shall be Equally divided between my legatees. I further desire that at the death of my wife that all my Estate both real and personal Shall be equally divided among my legatees or at any time my wife may See proper to divide of my Estate between Mary Gray & Frances C. Ogletree children now living & Silas Starr & John H. Starr & Hiliard M. Starr & Char- lotte P. Simmons & William D. Starr & Martha A. Ogletree Surviv- ing children. Item Sixth I desire that my Executors employ Some Suitable per- son to wall in the grave of Alatha Jarrot & Frances C. Ogeltree & Martha A. Ogletree for which they may pay fifty Dollars out of my estate if needed. Item Seventh I constitute and appoint my beloved wife Charlotte Executrix and my beloved Son John H. Starr & Hiliard M. Starr Ex- ecutors to this my last Will and Testament this 24th June 1851.
