All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beth Collins http://www.genrecords.net/emailregistry/vols/00011.html#0002523 October 4, 2009, 8:20 pm Written: September 26, 1758 Colonial Deed Book C1, p. 353 Georgia To all Christian people to whom these presents shall come Benjamin Andrew of Newport in the parish of St. Johns & abovesd province planter sendeth greetings Know Ye that the said Benjamin Andrew for and in consideration of the sum of Thirty seven pounds sterling to him the said Benjamin Andrew in hand at and before the Ensealing and delivery of these presents well and truly paid by James Andrew of the same parish and province aforesaid planter the receipt whereof the said Benjamin Andrew doth hereby acknowledge and thereof and of every part and parcel thereof doth requite Exonerate and discharge the said James Andrew his heirs Executors and Administrators and by these presents hath given granted bargained sold aliened enfeoffed and confirmed and by these presents doth fully freely clearly and absolutely give grant bargain sell alien enfeoff and confirm to the said James Andrew his heirs Executors Administrators and Assigns for ever; a certain parcel or tract of land containing one Hundred and six Acres or thereabouts be the same more or less situate on a swamp commonly called the Ash swamp on Newport in St Johns parish butting and bounding to the North on lands of the said Benjamin Andrew to the south on land of the said James Andrew and John Winn to the East on lands of John Stewart to the west on the said John Winn as by a platt hereunto annexed & reference being thereunto had, will more fully and clearly appear together with the ways privileges, Easements Immunities hereditaments and Commatities thereunto belonging or by any means appertaining To have and to hold the above granted premises and privilege of hunting, hawking fishing and fowling within the bounds and limits of the same And all the buildings houses woods Trees waters forever and other things thereon standing growing or being or thereon to by any means belonging or appertaining Excepting the quit rent hereafter to become due and payable for the same to him the said James Andrew his heirs and Assigns for ever to his and there own proper uses benefit and behoof for evermore And the said Benjamin Andrew for himself his heirs Executors & Administrators doth covenant and promise to and with the said James Andrew his heirs and Assigns in manner and form following that is to say that at the time of this presents bargain and sale, and until the Ensealing and delivery of these presents He the said Benjamin Andrew is the true sole and lawfull owner of all the above granted premises and hath in himself good & right full power & lawfull authority to grant sell or convey and assure the premises in manner and form as aforesaid and that the said James Andrew his heirs and assigns shall and may from henceforth and for ever here after by force and virtue of these presents lawfully peaceable and quietly have hold use occupy possess and injoy the above granted premises and there Appurtenances and every part and parcel thereof without any lett molestation Trouble Denial Expulsion Eviction or Contradiction from him the said Benjamin Andrew his heirs Executors or administrators or any other person or persons whatsoever claiming or having any lawfull claim Rite Title or Interest therein from by or under him or by any other lawfull ways or means whatsoever and also that the said Benjamin Andrew his heirs Executors or Administrators shall and will upon every reasonable request and at the Cost and charges in the law of the said James Andrew his heirs Executors, Administrators or assigns, further do and execute or cause to be done and Executed all and every such further and other lawfull and reasonable act or acts deed and deeds conveyances and Assurances in the law whatsoever for the more perfect conveying confirming and assuring the premises with there appurtenances, unto the said James Andrew his heirs or Assigns on his or their Council learned in the law shall be reasonable advised, devised ore required In Witness whereof the said Benjamin Andrew and Susannah Andrew in token of her consent to this act and deed of her husbands have hereunto set there Hands and seals the twenty sixth day Sept in the thirtysecond year of his Majestys Reign And in the year of our Lord, One thousand seven Hundred and fifty eight Signed sealed & delivered in presents of Bn Andrew Lydia Sanders Susannah Andrew John Osgood John Winn I the subscriber one of the Witnesses to the present deed did see the said Benjamin Andrew delivery make of the above mentioned tract of land by Turf and Twig the year day above mentioned John Osgood Receiv’d the day and year within written from the within names James Andrew the sum of thirty seven pounds sterling current money of the sd province being in full of the Consideration money within mentioned Witness Bn Andrew John Osgood John Winn File at: http://files.usgwarchives.net/ga/statewide/deeds/andrew186ndd.txt This file has been created by a form at http://www.genrecords.net/gafiles/ File size: 5.7 Kb
