COX of said State and County do hereby make and constitute this my last will and Testament as follows. Item 1st I will and direct that all of my property, real and personal, shall be kept together as long as my wife Mary or my son Jefferson L. or either of them may live; provided that my Executor and Executrix hereinafter named shall have power to sell any portions of my real estate except that portion hereinafter bequeathed to my son John Cary, at public outcry to the highest bidder whenever it may be advisable to do so and to sell any portion of my personal or perishable property except enough to pay my son John Cary the legacy hereinafter given to him, whenever it may be advisable to do so; the perishable property to be sold either privately or publicly, as may seem best. Item 2nd It is my will and desire that my wife Mary and my son Jefferson L. shall be supported with the income and proceeds of my estate as long as they may live. Item 3rd It is my will that after the death of my wife Mary and my son Jefferson L. my son John Cary shall have three choice feather beds, bedsteads and furniture, three mules or horses one good buggy and fire ____ and ______. Item 4th I also give and bequeath to my son John Cary that portion of my land known as my store house field, my gin house field, down to the branch next to J. D. WILSON's, my tan yard field and the whole of my creek Swamp with my dwelling house and all the other improvements on the said parcels of land. The said parcels of land and improvements to belong to him at the death of my wife Mary and my son Jefferson L., to him my son John Cary and heirs forever. Item 5th It is my will and desire that after the death of my wife Mary and my son Jefferson L. that all that pertain of my estate not heretofore given to my son John Cary, shall be sold and the proceeds equally divided between my children except my son John Cary. Item 6th I hereby appoint my wife Mary Executrix of this my last will and testament and at her death it is my will that my son-in-law, Mathew L. BEVINS, shall be the Executor of this my last will and Testament, which appointment I hope neither of them will refuse. January 22nd 1867 James R.
