Stewart Lot #251 in 15th District of Sumter County, Georgia Written: February 23, 1855 Recorded: April 3, 1855 132-4 HL 239 Sumter County, Georgia Superior Court General Index Deeds Volume K 1853-1857 Page 590-591 State of Georgia} This Indenture made and entered into this the twenty third Sumter County } day of February in the year of our Lord Eighteen hundred and } fifty-five between John C. Frazer of the county and state aforesaid of the county aforesaid and James Aycock of the same county and state aforesaid witness that the John C. Frazer hath this day made and delivered to William R. Stewart or bearer his certain promissory note subscribed with his own hand and James Aycock security due the twenty fifth day of December Eighteen hundred and fifty five baring even date with these presents where of the said John C. Frazer hath promised to pay the said William R. Stewart or bearer the sum of one hundred and twenty dollars on or before the twenty fifth day of December next ensuring the date here of for value rec'd. Now for and in consideration of the sum of five dollars by the said James Aycock to the said John C. Frazer in hand in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged as well as for securing the said promissory note to the said William R. Stewart made to secure the said James Aycock as security as aforesaid hath granted bargained deeded and sold said James security aforesaid his his executors Administrators and assigns all that tract or parcel of Land lying and being in the fifteenth District of formerly Lee now Sumter County known in the plan of said district by the north half of Lot number two hundred and fifty one whereon the said John C. Frazer now resided containing one hundred one and a fourth acres more or less with all rights and members and appurtenances to said parcel of Land or in any wise appertaining or belonging. To have and to hold the bargained premises to the said James Aycock security as aforesaid his heirs and assigns to his and their own proper use benefit and behoof for ever in fee simple and the said John C. Frazer for himself his heirs executors administrators the said bargained premises unto the said James Aycock will warrant and forever defend against the claim of himself and his heirs and against the claim of all persons whatsoever-- Provided nevertheless if the said John C. Frazer his heirs executors administrators shall well and truly pay or cause to be paid unto the said William R. Stewart his heirs and assigns the afore mentioned sum of one hundred and twenty dollars on the day & time mentioned and appointed for the payment thereof in the said promissory note aforesaid with Lawful interest for the same according to the terms of said note then and thenseforth as well as this present indenture and the right to the property thereby conveyed as the said promissory note shall erase determin and be void to all intents and purposes.
