ROBERSON of the county aforesaid of the one part & Thomas W. ROBERSON of the same county of the other part. Witnesseth, that whereas Lewellen M. ROBERSON of the first part hath this day made & delivered to said Thomas W. ROBERSON his certain promissory note bearing even date with these presents whereby said Lewellen M. has promised the day after the date of said note to pay said Thomas W. ROBERSON or bearer the sum of Two hundred and nineteen dollars & seven cents for value received, and whereas said Lewellen M. did on the first day of January in the year aforesaid rent from said Thomas W. ROBERSON the one half of the lot or tract of land, whereon said Thomas W. now resides & did there & then promise & agree to pay said Thomas W. for said rent, the one half of the crop of corn and cotton made by said Lewellen M. in the year aforesaid and on the land so rented as aforesaid. Now for & in consideration of the sum of five dollars by said Thomas W. to said Lewellen M. in hand paid at & before the sealing & delivery of these presents, the receipt whereof is hereby acknowledged, said Lewellen M. ROBERSON has granted bargained & sold & by these presents does grant bargain & sell unto said Thomas W. ROBERSON his heirs & assigns as well for the better securing of payment of the promissory note aforesaid & rent aforesaid as for said sum of five dollars, the following property to wit, all his (said Lewellen M.) interest and claim to the crop now growing on the land rented as aforesaid, twelve head of hogs, now in the possession of John MALPASS and five head of Cattle in the possession of said Lewellen M. To have and to hold the property aforesaid to him said Thomas W. his heirs & assigns to his & others own proper use & benefit forever, and the title to the same said Lewellen will forever warrant & defend against all persons Provided nevertheless that if said Lewellen M. ROBERSON shall well and truly pay or cause to be paid to said Thomas W. ROBERSON the sum of money in said note aforesaid at the time appointed for the payment thereof according to the tenor and effect of said note & the rent for said land then the promissory note as well as this indenture shall cease determine [= terminate?] & be void to all intents & purposes. Additional Comments: Lewellen (Luellen) M. later used the spelling ROBINSON in Walton & Santa Rosa counties, Florida. Thomas W. later used the spelling ROBERTSON in Butler & Crenshaw counties, Alabama. It is supposed that they are kin, probably as brothers. John MALPASS mentioned is surely a kinsman of Lewellen's wife, Luvisa Ann (MALPASS) ROBINSON.
