G. Currington, under a death sentence for the murder of his brother, H. H. Currington, in Talbot county Saturday denied a new trial, Judge C. Frank McLaughlin announcing that he had overruled the condemned man's motion. The decision was announced Saturday following additional arguments by counsel Friday afternoon. The attorney is John H. McGehee, of Talbotton. The amended motion contained but two grounds. There were no exceptions to Judge Mclaughlin's charge, but it was claimed that he erred in ruling out evidence on two occasions. The motion excepted to Judge McLaughlin's refusal to permit the presentation of evidence regarding a civil suit between the defendant and his brother. It also claimed that the court erred in declining to permit testimony that a person could not distinguish a pistol held in another person's hands 200 yards distant. Currington was convicted in Talbot county superior court in September and he was sentenced to die in the electric chair October 16. The execution was stayed, however, because the new tral hearing was continued to a date after the scheduled electrocution. Currington was convicted of shooting his brother to death at Junction City April 15, 1925. Counsel for Currington will noe appeal the case to the state supreme court.
