I, John H. Caldwell, of said State and County, being somewhat advanced in age and knowing that I must shortly depart this life and being of sound and disposing mind and memory, deed it right and proper that I should make this my last Will and Testament. Item 1st I desire a decent and Christianlike burial Item 2d It is my will and desire that all my property both real and personal of which I died possessed shall be sold at as early a time a practicable after my decease and all my just debts shall be paid out of the proceeds as soon as practicable Item 3d It is my will and desire that after all my property is sold and the money which it may bring shall be all collected together that it shall be dqually divided between all my legal heirs and that my beloved wife Susan G. Caldwll shall have an equal share with my children, to wit: my son Pleasant C. Caldwell; my daughter Mary E. Adams; my daughter Julia M. Bius; my daughter Lenora W. Adams; my son William L. Caldwell; my son David Lee Caldwell. Item 4th My daughter Martha M. Caldwell, having intermarried with Thomas Gunnells, and since deceased, leaving one heir, Augustus Gunnells, it is my will and desire that the said Augustus Gunnells, son of my daughter Martha M. Caldwell, deceased shall received an equal share with my own children, in any estate, and I hereby appoint and constitute my son, Pleasant C. Caldwell, as Guardian of said Augustus Gunnells, until he shall have arrived at the age of twenty-one years, and he [Augustus Gunnells] shall not be entitled to receive any part of this bequest until he arrives at the age of twenty-one years; and the said Pleasant C. Caldwell, as Guardian of said Augustus Gunnells, shall receive and take charge of the above described bequest and use it to the best advantage and when said Augustus Gunnells shall arrive at the age of twenty-one years, the said Pleasant C. Caldwell, Guardian of said war, shall pay over to said Augustus Gunnells the principal with lawful interest - the interest to commence from the time said bequest goes into the hands of said Guardian; but if said Augustus Gunnells shall died before reaching the age of twenty-one years, then the part or bequest of said Augustus Gunnells shall be equally divided between the heirs above mentioned in this will, and said Guardian, Pleasant C. Caldwell, shall not pay any interest on said bequest, provided said Augustus Gunnells shall die before reaching the years of majority. 279 Item 5th I hereby appoint my sons; Pleasant C. Caldwell ^ Executors ^ Petition for leave to sell land. John H. Caldwell ^ Georgia Talbot County To Richard H. Leonard, Ordinary of said County: The petition of Pleasant C. Caldwell and William L. Caldwell, Executors of the Estate of John H. Caldwell, late of said County, deceased , shows that said deceased owned at the time of his death a certain boyd of land containing four hundred acres, more or less, whereone deceased resided at the time of his death - said land being bounded a follows: - On the north by the lands of Lewis Potter and Flint River; on the east by Flint River; on the south by the Lands of A. U. Walker and Arch' Adams and Leonard Carter & on the west by the lands of Lewis Potter. And for the purposes of paying the debts and making distributions among the heirs of said Deceased it is necessary to sell the land of said deceased Wherefore Petitioners pray an oder directing citation to issue and be published in terms of the Law, and that if no good cause be shown to the contrary Your petitioners be granted leave to sell said land Martin O Worrill This Sept. 20, 1884 Petrs. attys.
