Will Book B Pages 355-357 I, Marion Bethune being of advanced age but of sound and disposing mind and memory do hereby obtain make publish this Instrument of writing to be my last will and testament having never before made any will. 1. I want a cheap burial. All the property and effects of every sort kind and description, whether real or personal (word unreadable) in action – I give the whole to my wife F.J. Bethune to be kept and used by her during her natural life with full power to sell & to buy such things as she may think best for herself whilst living and such sales to be made privately or publicly so as to provide for her the necessities of life in as full a manner as I could do were I living. This power does not allow her to sell the lands whereon we live but anything else she may want to sell of exchange – but she has full power to lease or rent it & apply the proceeds to such use as she thinks proper. May lands whereon I now live at the death of my wife I want divided as follows – all lying on the North side of the road leading from Talbotton to Columbus, Ga. I give at the death of my wife to my daughter, C.M. Byland & A.D. Bethune except ¼ acre around the Blacksmith shop which I give to W. Mc. Bethune. All lands lying South of said road leading from Talbotton to Columbus – at the death of y wife to be the property of my sons Benjamin P. Bethune, Al. Solon Bethune, F.M. Bethune & W. Mc. Bethune to be divided by them or by commissioners appointed by the Ordinary. I direct that my Isom land and all my wild lands (which can be found in Tax Digest of Talbot Co. for 1887) be sold privately or publicly as my Executrix or Executor may deem best, without any orders to sell the same of rented if not sold to pay my debts, which are very small as I have been working out for years and any balances left held by them for J.B. Bethune if he calls for it, until he is made equal to Benj. P. & A.S., W. Mc. & F.M. Bethune if sufficient and if there is still a balance it can be turned over to my said wife for her use and then the balance of all that is left of everything is at the disposal of my wife as she thinks best by will or otherwise. Having given C.M. Bethune a full share of what I had – more than any of the other children have or will ever receive of me I direct that he take no share or part of my effects. I nominate and appoint my wife Frances Jane Bethune my Executrix and Alfred Solon Bethune Executor, giving them full authority to sell any of the effects belonging to my Estate without an order of Court, privately or publicly, or to lease or let out lands for a period of one year or less not selling the lands where we live. After paying my debts from the sale of the Isom land and the wild land if my wife should use the balance left over before the said J.B. Bethune calls for it I request that she if able make up to him such sum as Ben, Frank, Mac and Solon have received under this will with these request and the specific legacies & direction for paying debts she is at full liberty to dispose of all that is left after defraying expenses as she pleases by will or otherwise. Marion Bethune (Seal) Signed sealed and declared by Marion Bethune as his last will and testament in the presence of each of us who have each signed the same as subscribing witnesses at the request of said Marion Bethune and in his presence and the presence of each other. 26th October 1887 B.A. Richards W.J. Raines R.H. Leonard Georgia, Talbot County I, W.J. Raines and B.A. Richards do swear that we as well as Richard H. Leonard saw the within named Marion Bethune sign and publish the within paper as his last will and testament; that we subscribed the same as witnesses thereto at the special instance and request of the said Marion Bethune and in his presence as did also Richard H. Leonard that the said Marion Bethune signed the same freely and voluntarily and was at the time of such signing of sound and disposing mind and memory. W.J. Solon Bethune do solemnly swear that this writing contains the true last will and testament of the within named Marion Bethune, deceased, so far as I know or believe an that I will well and truly execute the same in accordance with the laws of this state: So help me God.
