Stephenson, Jr. January 2002 Last Will and Testament of John Chapman Transcribed by William L. Stephenson, Jr. January 2002 Taliaferro County, Georgia. Will Book A., Page 266 In the name of God, Amen. I, John Chapman, being of sound mind and disposing memory do make and establish this my last will and testament. 1st. It is my will and desire that all my just debts be paid. 2nd. That it is my will and desire that my property be kept together until my sons Samuel N. Chapman and John T. Chapman shall have completed education. Their education and their expenses to be paid out of my estate before any distribution shall be of said estate. And that the education of my daughter Rachel Ann Judson Chapman be paid out of my estate. Until my son John T. Chapman shall finish his college courses or become of age, and then if my Executors hereinafter named may deem it necessary to complete the education of my daughter Rachel Ann Chapman they are authorized to do so out of my undivided estate. 3rd. It is my will when my son John T. Chapman comes of age that my estate be divided between my beloved wife, Rachel B. Chapman, and my children. The children of my present wife and my wife to have $500.00 more that my daughter, Susan M. Allen. She has received that amount from her grandfather King’s estate. And as my daughter Sarah Jane Chapman has lived with us several years after coming of age I give her bed and furniture above what I give to my other children. 4th. Should my sons William C. or Samuel N. marry or wish to go to housekeeping before my son John T. Chapman comes of age, I wish them to have a bed and furniture, and such other things as they need and my wife can share at a fair valuation, to be valued by my brother Samuel N. Chapman, Jackson Henry, and John Rhodes, Jr., or any other three disinterested persons that my executors may choose. 5th. I lend unto my beloved wife for life the land whereon we now live, and it is my will that my daughter Sarah Jane Chapman has a home free of charge as long as she remains single and her and my wife wish to live together on the plantation where we now live. 6th. Should any of my slaves become rougish of refactory so that my wife cannot control them and should it be necessary for the education of my children or support of my family then my Executors are authorized to sell or hire out such slave or slaves at public sale or private contract, as they may think best, for this estate; and the proceeds to be equally divided between my wife and children provided the proceeds are really needed for the comfort and support of my family. 7th. It is my will that after the Negroes are appraised that my wife shall have in the distribution the privilege of selecting lot before they are thrown together to be drawn. And it is further my will and desire that my beloved wife have the use and control of my stock, plantation, and everything not heretofore named until my son John T. Chapman comes of age, and to have the land during her life. Also that she has my best buggies and horses, as she may choose and one year provisions for my daughter Rachel Ann Judson Chapman, and also for my daughter Sarah Jane Chapman, Provided she is not married and wishes to remain with her step-mother. It is also my will that my wife has as many hogs and cattle, as many beds and furniture as my executors think best for her to keep. And such books as she may select out of my library. The books which have been may be bought as school books, I give them for whom they were bought. The rest of my books to be divided between my children as I do not wish them to be sold. And lastly I nominate and appoint my sons William C., Samuel N., and John T. Chapman Executors of this my last will and testament. Recorded Nov. 6, 1860 to render a true correct account of the estate of John Chapman - Dec - until the administration is fully completed. John T.
