I Charity Colclough of said State and County being of advanced age and Knowing that I must Shortly depart from this world deem it right and proper both as respects myself and my family that I should make a disposition of the property with which a kind providence has blessed me; I therefore make this my last will and testament. Item 1st,, I devise and direct that all my Just debts be paid by my Executors out of the proceeds of the sale of my property. Item 2nd,, I give and devise to my beloved daughter Patsy Morriss wife of Simon Morriss one Bed and furniture. Item 3rd,, I give and devise to my beloved daughter Elizabeth O’Neal widow of Harrison O’Neal deceased, one bed and furniture, one trunk and my saddle and Bridle. Item 4rth,, I give and devise to my beloved son John Colclough one slab and one counterpain . Item 5th,, I give and devise to my beloved daughter Rhachael Chapman wife of John Chapman one Folding Table. Item 6th,, I give and devise to my beloved son Alexander Colclough one desk. Item 7th,, I give and devise to my beloved son William Colclough One Chest. Item 8th,, I give and devise to my beloved son Charles H. Colclough my negro woman Martha and her two children , to wit. Sam and Jude, one horse colt, one bed and furniture and one set China cups and saucers. Item 9th,, The rest of my property both Real and Personal what wherever and whatever I wish to be sold at public out cry and after paying Just debts out of the proceeds of said sale, then the balance of sale money to be equally divided amongst my several Children , to wit., Patsy, Elizabeth, John, Rachael, Alexander, William and Charles H. Item 10th,, I Constitute and appoint my beloved sons Alexander and William Colclough Executors to my last will and testament this October 28, 1840 X (seal) Mark of Charity Colclough Signed sealed declared and published by Charity Colclough as last will and testament in the presence of us the subscribing who subscribed our names hereto in the presence of said testator and each other this October 28, 1840 Singleton Harris Reuben H. Stewart William F. Stewart Georgia Taliaferro County – Court of Ordinary – at chambers Nov 12th, 1846. Present Gilbert Kent and John Rhodes Justices – The last will and testament of Charity Colclough was produced by Alexander Colclough one of the Executors in said will named And was proven in common form of law by the oaths of Singleton Harris, Reuben H. Stewart, and William F. Stewart Dec 7th,, 1846. The Honorable the Inferior Court of Taliaferro County set agreeable to adjournment for ordinary purposes present their Honors, Buford Bird, William Evans, Gilbert Kent, & Elisha Moore Justices – In open court came Alexander Colclough, William Colclough Executors to said will and were duly qualified in open court. And it is Ordered by the court that said will and proceedings be recorded, and letters testamentary do issue to said qualified Executors with a copy of sid will annexed Attest Zuinea O’Neal Clerk C.O. Additional Comments: She was born about 1758 in what was then Granville County, North Carolina. The place where she grew up later became part of Bute County in 1764 and then Warren County in 1779. She was the daughter of Charles Harris who died intestate in Warren Co. NC in 1786 and his wife Rachel Egerton who died testate in Warren County NC in 1823. Charity is mentioned in her mothers will as Charity Cockly which much be a mispelling and possible mispronunciation of Colclough. She married William Colclough in Warren County NC. William and Charity Colclough moved to Greene County, Georgia where William Colclough died about 1821.
