Swain Written: July 12 1865 Recorded: March 6 1869 The following was transcribed by Robert H. Swain. Will of Richard D. L. Peek Georgia, Taliaferro County I RICHARD D. L. PEEK of the State and County aforesaid being of sound mind and disposing memory do make, declare and publish this my last will and testament hereby revoking and annulling all other wills heretofore made by me. Item 1st – It is my will and desire that all my just debts be paid as soon after my death as practicable by the Executors herein after appointed. Item 2nd – I give and bequeath to my wife Marian A. M. Peek my gray horse and Buggy and one third of all my household and kitchen furniture and the sum of Five Hundred Dollars in cash. This I give to her in lieu of Dower and it is all that I intend to give her or for her to have out of my estate, but she can remain at my house with my children and receive her board at my estate free of charge so long as she remains a widow but no longer – neither do I wish her to receive her board out of my estate any longer than she remains on my plantation. The property I have herein given to my wife is as much as the treatment she has always given me deserves, for she has never been to me either a kind, affectionate, or dutiful wife. Item 3rd – I give and bequeath to my daughter Arabella my gold watch to be given to her when she arrives at fourteen years of age, and when my daughter Octavia N. arrives at fourteen years of age I wish my Executors hereinafter appointed to buy and deliver to her a gold watch equal in value to the one I have herein given to my daughter Arabella – I wish my plantation to be kept for the joint use of my two daughters until one of them marries or until my daughter Arabella arrives at twenty one years of age, then I wish Arabella to have it, and my Executors to buy one of equal value for my daughter Octavia N. Taylor ---------------- Taliaferro County Thos. J. Peek, Propounder of R. D. L. Peek’s Will vs M.A.M. Peek, Caveatrix In Taliaferro Supr. Court on appeal from the Court of Ordinary – Febry Term 1869. The above stated case having been submitted to a jury and they having brought in a verdict setting up the paper propounded, as the last will and testament of said R.D.L. Peek. On motion of counsel for the propounder, it is ordered that the paper in said case be transmitted to the Court of Ordinary and that the paper propounded as the will of said Testator be recorded by the Ordinary as duly proven in solemn form. Hammack, Ordinary Additional Comments: Richard Donald Lewis Peek was born June 17, 1826 and died 1865-66, son of James H. Peek, Sr. and Margaret Swain. He married his first cousin, Marian Antoinette Swain, December 25, 1853 in Taliaferro County (Marriage Bk. A, page 246). Marian was born February 4, 1834 and died April 15, 1906, daughter of James Grover Swain and Mary Ann Bird. Richard D. L. and Marian had two daughters and one son who died as an infant: (1) Arabella Peek, born Nov. 14, 1856 and died 1878 in Taliaferro County. Arabella was first wife of my grandfather, William Chesley Taylor (married January 12, 1875, Taliaferro County). They had one son, Robert Lovell Taylor. (2) Octavia Narcissa Peek, born October 8, 1858, died Nov. 14, 1905. She married William A. Wagnon, December 19, 1875, Taliaferro County. (3) An infant son, unnamed, buried in the Peek cemetery in Taliaferro County. After the death of Richard D. L. Peek, his widow married Henry D. Smith, June 16, 1867 (Taliaferro Co. Marriage Bk.
