Item 1st I will and devise that all my just debts be paid by my Executors hereinafter appointed as soon as practical after my death out of any money notes cotton or crop I may have on hand at the time of my death – Item 2nd I wish all my property both real and personal of every kind and description to be kept together for the maintenance and support of my wife Martha A. E. Rhodes and for the maintenance support and education of all my children [now?] living or hereafter to be born unto me, until my youngest child arrives at twenty one years of age – then I wish all my said property to be divided among my said wife and all of my said children living at that time and the representatives of such of my children as may be dead at that time leaving representatives, share and share alike – Said representatives taking by representation - The property herein willed to my said wife I will to her only for and during her natural [life] and at her death I wish the property herein willed to her to be divided among all my children living at that time and the representatives of such of my children as may be dead at that time leaving representatives - Said representatives taking by representation. But should my said wife take dower in my lands I do not wish her to have anything else out of my real estate and should she marry before my youngest child arrives at twenty one years of age, then and in that case it is my will and desire that she receive nothing out of my estate except dower in my lands, and one bed bedstead, and a sufficiency of bed clothing for one bed, also one horse, one cow and calf, and one sow and pigs such as she may select out of all my stock of horses, cattle and hogs – Item 3d It is my will and desire that all the money that may be due and coming to my estate or heirs at my death, from any insurance companies, be invested by my Executors hereinafter appointed, in some good paying Rail Road Stock and the interest thereof used if it should be needed in the support and education of my children, and as each of my children respectively arrives at twenty one years of age, then I wish my executors hereinafter appointed to pay over to him or her on arriving at twenty one years of age his or her distributive share or interest in the fund mentioned in this the third item of this my will - It is my wish that my wife take no interest or share in the money or fund mentioned in this the third item of my will, but that the whole of said money or fund shall go to and belong to my children and used and divided among them as above stated – Item 4th I hereby nominate constitute and appoint my Brother, John Rhodes and friend John T. Chapman Executors to this my last will and testament herein written on the two foregoing pages and continued on this the third page, and I wish them to manage my estate in all things as in their judgment will be to the best interest of my estate and not inconsistent with the spirit and tenor of this my will – In witness whereof I William Rhodes have hereto set my hand this the twenty third day of November eighteen hundred and sixty eight – /s/ William Rhodes Signed acknowledged declared and published by William Rhodes as his last will and testament in the presence of us who by his request signed the same as witnesses thereto in his presence and in the presence of each other, this the 23rd day of November 1868. Acree Georgia Taliaferro County Court of Ordinary March Term 1869 It appearing to the Court that the last will and testament of Dr. William Rhodes having been filed at the Febry Term of the Court of Ordinary by the Executors therein named, to wit, John Rhodes and John T. Chapman, for probate in solemn form at this present time, and that proper citation has been issued to Martha A.E. Rhodes widow of said deceased, and to Absalom Rhodes gdn ad litum for the 6 minor children of the deceased as appears on file in this office, and that said will having been fully proven by the oaths of all the witnesses to said [will] to wit: William N. Gunn, Thomas L. Chapman and Seaborn N. Acree, who swear they saw Testator sign the same, that he done so in their presence and freely and voluntarily, and that they signed the same in presence of testator and in presence of each [other] at testators request. It is therefore Ordered and adjudged by the Court that said paper is proven in solemn form as the last will and testament of said William Rhodes deceased, and that it be established as such and recorded as required by Law. March 1st 1869 J.D. Hammack, Ordinary Letters Testamentary Georgia Taliaferro County By the Hon the Ordinary of said County To all to whom these presents shall come. Know ye that on the first day of March in the year of our Lord 1869 the last will and testament of Dr. William Rhodes of said county deced was exhibited in open Court, and in Solemn force of Law, proved and admitted to Record, a copy of which is hereunto annexed; and administration of all and singular the goods, chattels, credits, lands and tenements of said deceased, was granted to John Rhodes and John T. Chapman the Executors in and by said will named and appointed, they having first taken the oath and performed all other requisites required by Law, they are by order of said Court and by virtue of these presents, legally authorized to administer the goods, chattels, credits, lands and tenements of said deceased according to the tenor and effect of said will and testament and according to law and they are hereby required to render a true and perfect inventory of all and singular the goods, chattels, credits, lands and tenements of the said deceased, appraised and returned to this Court according to Law, and to render a true and correct account to the Ordinary of said County of their actings and doings yearly until their administration is fully completed. Hammack Ordinary Additional Comments: Dr. William Rhodes was son of John Rhodes, Sr. and Nancy McGinty, born about 1831, Taliaferro County, GA. He married Martha A. E. Bickers, 21 December 1854, daughter of William Bickers and Nancy Evans (Widow of John Ivey). Children of Dr. William Rhodes and Martha A.E. Bickers were: 1. William B. C. Rhodes, b. ca. 1856. No further information. 2. Henry T. A. Rhodes, b. ca. 1858, married 13 April 1879 to Bird Winburn (Taliaferro Co., GA Mar. Bk. B.) Note: the spelling of her surname is uncertain. 3. Nancy Coma L. Rhodes, b. ca 1859. Married 31 Aug 1879 to William Wynne (Taliaferro Co. Mar. Bk. B) 4. Mary L. Rhodes, b. ca. 1861, died 1884, Taliaferro Co. Apparently never married. 5. Lenora “Nora” Rhodes, b. February 1862 (1900 Census). Married (1) 10 Feb. 1881 to William Isaac Taylor (Taliaferro Co. Mar. Bk. B). He was born 1859, died 1892, son of Joel G. W. Taylor and Frances W. Moore. Nora married (2) ca 1899 to William H. Sills (1900 census, Richmond Co., GA shows married 1 year). 6. Lena Rhodes, born August 1868 (1900 Census), died 30 March 1954, Taliaferro Co. Married 1 July 1891 to Charles William Gee (Taliaferro Co. Mar. Bk. C), son of William Jordan Gee and first wife, Sabra Ann Harrell.
